Be it enacted by the Senate and House of Representa- 1 tives of the United States of America in Congress assembled, 2 SECTION 1. USE OF HARBOR MAINTENANCE TRUST FUND TO 1 SUPPORT NAVIGATION. 2 Section 210 of the Water Resources Development Act 3 of 1986 (33 U.S.C. 2238) is amended— 4 (1) in the section heading, by striking ‘‘AU- 5 THORIZATION OF APPROPRIATIONS’’ and insert- 6 ing ‘‘FUNDING FOR NAVIGATION’’; and 7 (2) by adding at the end the following: 8 ‘‘(g) ADJUSTMENTS TO DISCRETIONARY SPENDING 9 LIMITS.—Amounts made available from the Harbor Main- 10 tenance Trust Fund under this section or section 9505 11 of the Internal Revenue Code of 1986 shall be made avail- 12 able in accordance with section 251(b)(2)(G) of the Bal- 13 anced Budget and Emergency Deficit Control Act of 14 1985.’’. 15 SEC. 3. ANNUAL REPORT TO CONGRESS. 16 Section 330 of the Water Resources Development Act 17 of 1992 (26 U.S.C. 9505 note; 106 Stat. 4851) is amend- 18 ed— 19 (1) in subsection (a)— 20 (A) by striking ‘‘and annually thereafter,’’ 21 and inserting ‘‘and annually thereafter concur- 22 rent with the submission of the President’s an- 23 nual budget request to Congress,’’; and 24 VerDate Sep 11 2014 05:27 May 01, 2019 Jkt 089200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\H2396.IH H2396 kjohnson on DSK79L0C42 with BILLS 3 •HR 2396 IH (B) by striking ‘‘Public Works and Trans- 1 portation’’ and inserting ‘‘Transportation and 2 Infrastructure’’; and 3 (2) in subsection (b)(1) by adding at the end 4 the following: 5 ‘‘(D) A description of the expected expend- 6 itures from the trust fund to meet the needs of 7 navigation for the fiscal year of the budget re- 8 quest.’’. 9 SEC. 4. HARBOR MAINTENANCE TRUST FUND DISCRE- 10 TIONARY SPENDING LIMIT ADJUSTMENT. 11 Section 251(b)(2) of the Balanced Budget and Emer- 12 gency Deficit Control Act of 1985 (2 U.S.C. 901(b)(2)) 13 is amended by adding at the end the following: 14 ‘‘(G) HARBOR MAINTENANCE TRUST 15 FUND.— 16 ‘‘(i) IN GENERAL.—If a bill or joint 17 resolution making appropriations for a fis- 18 cal year is enacted that specifies an 19 amount for harbor maintenance activities, 20 then the adjustments for that fiscal year 21 shall be the total of such amount in that 22 Act for such purpose for that fiscal year, 23 but may not exceed the total amount with- 24 in the Harbor Maintenance Trust Fund 25 VerDate Sep 11 2014 05:27 May 01, 2019 Jkt 089200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6201 E:\BILLS\H2396.IH H2396 kjohnson on DSK79L0C42 with BILLS 4 •HR 2396 IH under subsection (a) of section 9505 of the 1 Internal Revenue Code of 1986 on the last 2 day of the fiscal year that is two years 3 prior to that fiscal year. 4 ‘‘(ii) LIMITATION.—The adjustment 5 under clause (i) with respect to an amount 6 made available for harbor maintenance ac- 7 tivities may only be made if such 8 amount— 9 ‘‘(I) is derived solely from funds 10 in such Trust Fund; and 11 ‘‘(II) is made available for ex- 12 penditures described under subsection 13 (c) of such section 9505.’’. 14 Æ VerDate Sep 11 2014 05:27 May 01, 2019 Jkt 089200 PO 00000 Frm 00004 Fmt 6652 Sfmt 6301 E:\BILLS\H2396.IH H2396 kjohnson on DSK79L0C42 with BILLS
