Be it enacted by the Senate and House of Representa- 1 tives of the United States of America in Congress assembled, 2 SECTION 1. AUTHORITY TO ENTER INTO ENERGY SAVINGS PER- 1 FORMANCE CONTRACTS. 2 Section 804(4) of the National Energy Conservation 3 Policy Act (42 U.S.C. 8287c(4)) is amended— 4 (1) in subparagraph (A), by striking ‘‘or’’ after 5 the semicolon; 6 (2) in subparagraph (B), by striking the period 7 at the end and inserting ‘‘; or’’; and 8 (3) by adding at the end the following new sub- 9 paragraph: 10 ‘‘(C) in the case of a contract in which the 11 United States Postal Service is a party— 12 ‘‘(i) the purchase or lease of low emis- 13 sion and fuel efficient vehicles, including 14 electric vehicles; 15 ‘‘(ii) a measure to upgrade a vehicle 16 owned, operated, leased, or otherwise con- 17 trolled by or assigned to the United States 18 Postal Service to increase average fuel 19 economy and reduce the emissions of car- 20 bon dioxide of such vehicle; or 21 ‘‘(iii) the construction or maintenance 22 of infrastructure, including electric vehicle 23 charging stations, to support vehicles de- 24 scribed in clauses (i) and (ii).’’. 25 VerDate Sep 11 2014 22:32 Apr 23, 2019 Jkt 089200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\H2337.IH H2337 kjohnson on DSK79L0C42 with BILLS 3 •HR 2337 IH SEC. 3. AUTHORITY TO ENTER INTO UTILITY ENERGY 1 SERVICE CONTRACTS. 2 Section 546 of the National Energy Conservation 3 Policy Act (42 U.S.C. 8256) is amended in subsection 4 (c)(1) by inserting ‘‘(including measures to support the 5 use of low emission and fuel efficient vehicles owned, oper- 6 ated, leased, or otherwise controlled by or assigned to the 7 United States Postal Service and measures to support con- 8 struction and maintenance of infrastructure to support 9 such vehicles, including electric vehicle charging stations)’’ 10 after ‘‘demand’’. 11 SEC. 4. UPGRADE OF POSTAL FLEET. 12 (a) POSTAL FLEET REQUIREMENTS.— 13 (1) MOTOR VEHICLE STANDARDS.—The Post- 14 master General may not award a contract for a con- 15 tracted vehicle, or purchase or lease a motor vehicle 16 for use by the Postal Service, unless, at a min- 17 imum— 18 (A) in the case of a passenger car, the car 19 meets— 20 (i) with respect to emissions of carbon 21 dioxide, the more stringent of— 22 (I) the applicable standards de- 23 veloped by the Environmental Protec- 24 tion Agency under title II of the Clean 25 Air Act (42 U.S.C. 7521 et seq.); and 2 (ii) with respect to average fuel econ- 3 omy, the more stringent of— 4 (I) the applicable average fuel 5 economy standards developed by the 6 National Highway Traffic Safety Ad- 7 ministration under chapter 329 of 8 title 49, United States Code; or 9 (II) 43.7 miles per gallon; 10 (B) in the case of a light truck, the truck 11 meets— 12 (i) with respect to emissions of carbon 13 dioxide, the more stringent of— 14 (I) the applicable standards de- 15 veloped by the Environmental Protec- 16 tion Agency under title II of the Clean 17 Air Act (42 U.S.C. 7521 et seq.); or 18 (II) on average, less than 269 19 grams per mile; and 20 (ii) with respect to average fuel econ- 21 omy, the more stringent of— 22 (I) the applicable average fuel 23 economy standards developed by the 24 National Highway Traffic Safety Ad- 25 VerDate Sep 11 2014 22:32 Apr 23, 2019 Jkt 089200 PO 00000 Frm 00004 Fmt 6652 Sfmt 6201 E:\BILLS\H2337.IH H2337 kjohnson on DSK79L0C42 with BILLS 5 •HR 2337 IH ministration under chapter 329 of 1 title 49, United States Code; or 2 (II) 31.3 miles per gallon; and 3 (C) in the case of a medium-duty or heavy- 4 duty vehicle, the vehicle complies with applica- 5 ble standards— 6 (i) for emissions of carbon dioxide de- 7 veloped by the Environmental Protection 8 Agency under title II of the Clean Air Act 9 (42 U.S.C. 7521 et seq.); and 10 (ii) for average fuel economy devel- 11 oped by the National Highway Traffic 12 Safety Administration under chapter 329 13 of title 49, United States Code. 14 (2) APPLICABILITY.—The standards described 15 in paragraph (1) shall apply to contracted vehicles 16 and motor vehicles purchased or leased for use by 17 the Postal Service after the date that is 1 year after 18 the date of enactment of this Act. 19 (3) REDUCTION IN CONSUMPTION OF PETRO- 20 LEUM PRODUCTS.—The Postmaster General shall 21 reduce the total consumption of petroleum products 22 by motor vehicles in the Postal fleet by a minimum 23 of 2 percent annually through the end of fiscal year 24 VerDate Sep 11 2014 22:32 Apr 23, 2019 Jkt 089200 PO 00000 Frm 00005 Fmt 6652 Sfmt 6201 E:\BILLS\H2337.IH H2337 kjohnson on DSK79L0C42 with BILLS 6 •HR 2337 IH 2029, relative to the baseline established for fiscal 1 year 2005. 2 (b) REPLACING VEHICLES WITHIN THE POSTAL 3 FLEET.—The Postmaster General shall conduct a cost- 4 benefit analysis of motor vehicles in the Postal fleet to 5 determine if the cost to maintain any such vehicle out- 6 weighs the benefit or savings of replacing the vehicle. 7 (c) ROUTE REQUIREMENTS.—To inform and priori- 8 tize purchases, the Postmaster General shall review and 9 identify Postal delivery routes, including geography and 10 types of motor vehicles that could be used on such routes, 11 to determine if motor vehicles used on such routes can 12 be replaced with motor vehicles that use technologies that 13 increase average fuel economy or reduce emissions of car- 14 bon dioxide. 15 (d) REPORTING REQUIREMENTS.—The Postmaster 16 General shall submit a report to Congress— 17 (1) not later than 1 year after the date of en- 18 actment of this Act, that contains a plan to achieve 19 the requirements of subsection (a) and recommenda- 20 tions for vehicle body design specifications for motor 21 vehicles purchased for the Postal fleet that would in- 22 crease average fuel economy and reduce emissions of 23 carbon dioxide of any such vehicle; and 2 (B) any changes to Postal delivery routes 3 or motor vehicle purchase strategies made pur- 4 suant to subsection (c). 5 (e) RESTRICTIONS.—To meet the requirements of 6 this Act, the Postmaster General may not— 7 (1) reduce the frequency of delivery of mail to 8 fewer than 6 days each week; 9 (2) close post offices or postal distribution fa- 10 cilities; 11 (3) take any action that would restrict or di- 12 minish a collective bargaining agreement or elimi- 13 nate or reduce any employee benefits; or 14 (4) enter into a contract with a private com- 15 pany to perform duties that, as of the date of enact- 16 ment of this Act, are performed by bargaining unit 17 employees. 18 SEC. 5. DEFINITIONS. 19 In this Act, the following definitions apply: 20 (1) CONTRACTED VEHICLE.—The term ‘‘con- 21 tracted vehicle’’— 22 (A) means any motor vehicle used in car- 23 rying out a contract for surface mail delivery 24 VerDate Sep 11 2014 22:32 Apr 23, 2019 Jkt 089200 PO 00000 Frm 00007 Fmt 6652 Sfmt 6201 E:\BILLS\H2337.IH H2337 kjohnson on DSK79L0C42 with BILLS 8 •HR 2337 IH pursuant to section 5005(a)(3) of title 39, 1 United States Code; and 2 (B) does not include any motor vehicle 3 used in carrying out a contract for surface mail 4 delivery pursuant to sections 406 and 407 of 5 such title. 6 (2) MOTOR VEHICLE.—The term ‘‘motor vehi- 7 cle’’ means any self-propelled vehicle designed for 8 transporting persons or property on a street or high- 9 way. 10 (3) POSTAL DELIVERY ROUTE.—The term 11 ‘‘Postal delivery route’’ means the transportation 12 route for surface mail delivery. 13 (4) POSTAL FLEET.—The term ‘‘Postal fleet’’ 14 means any vehicle that is owned, operated, leased, or 15 otherwise controlled by or assigned to the Postal 16 Service. 17 (5) POSTAL SERVICE.—The term ‘‘Postal Serv- 18 ice’’ means the United States Postal Service. 19 Æ VerDate Sep 11 2014 22:32 Apr 23, 2019 Jkt 089200 PO 00000 Frm 00008 Fmt 6652 Sfmt 6301 E:\BILLS\H2337.IH H2337 kjohnson on DSK79L0C42 with BILLS
