To amend title XVIII of the Social Security Act to provide for payments
for certain rural health clinic and Federally qualified health center serv-
ices furnished to hospice patients under the Medicare program.

A BILL
To amend title XVIII of the Social Security Act to provide
for payments for certain rural health clinic and Federally
qualified health center services furnished to hospice pa-
tients under the Medicare program.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.
3
This Act may be cited as the ‘‘Rural Access to Hos-
4
pice Act of 2019’’.

SEC. 2. MEDICARE PAYMENT FOR CERTAIN FEDERALLY

QUALIFIED HEALTH CENTER AND RURAL
2
HEALTH CLINIC SERVICES FURNISHED TO
3
HOSPICE PATIENTS.
4
Section 1834 of the Social Security Act (42 U.S.C.
5
1395m) is amended—
6
(1) in subsection (o), by adding at the end the
7
following new paragraph:
8
‘‘(4) PAYMENT
FOR
ATTENDING
PHYSICIAN
9
SERVICES
FURNISHED
BY
FEDERALLY
QUALIFIED
10
HEALTH CENTERS TO HOSPICE PATIENTS.—In the
11
case of services described in section 1812(d)(2)(A)(ii)
12
furnished on or after January 1, 2020, by an at-
13
tending
physician
(as
defined
in
section
14
1861(dd)(3)(B), other than a physician or practi-
15
tioner who is employed by a hospice program) who
16
is employed by or working under contract with a
17
Federally qualified health center, a Federally quali-
18
fied health center shall be paid for such services
19
under the prospective payment system under this
20
subsection.’’; and
21
(2) by adding at the end the following new sub-
22
section:

‘‘(x) PAYMENT FOR ATTENDING PHYSICIAN SERV-
24
ICES FURNISHED BY RURAL HEALTH CLINICS TO HOS-
25
PICE PATIENTS.—In the case of services described in sec-

tion 1812(d)(2)(A)(ii) furnished on or after January 1,

2020, by an attending physician (as defined in section
2
1861(dd)(3)(B), other than a physician or practitioner
3
who is employed by a hospice program) who is employed
4
by or working under contract with a rural health clinic,
5
a rural health clinic shall be paid for such services under
6
the methodology for all-inclusive rates (established by the
7
Secretary) under section 1833(a)(3), subject to the limits
8
described in section 1833(f).’’.
