SHORT TITLE. 1 This Act may be cited as the ‘‘Stop Iran From Smug- 2 gling Weapons to Terrorists Act’’. 3 SEC. 2. AUTHORITY TO PROVIDE ASSISTANCE AND TRAIN- 4 ING TO INCREASE MARITIME SECURITY AND 5 DOMAIN AWARENESS OF FOREIGN COUN- 6 TRIES BORDERING THE PERSIAN GULF, ARA- 7 BIAN SEA, OR MEDITERRANEAN SEA. 8 (a) PURPOSE.—The purpose of this section is to au- 9 thorize assistance and training to increase maritime secu- 10 rity and domain awareness of foreign countries bordering 11 the Persian Gulf, the Arabian Sea, or the Mediterranean 12 Sea in order to deter and counter illicit smuggling and 13 related maritime activity by Iran, including illicit Iranian 14 weapons shipments. 15 (b) AUTHORITY.— 16 (1) IN GENERAL.—To carry out the purpose of 17 this section as described in subsection (a), the Sec- 18 retary of Defense, with the concurrence of the Sec- 19 retary of State, is authorized— 20 (A) to provide training to the national mili- 21 tary or other security forces of Israel, Bahrain, 22 Saudi Arabia, the United Arab Emirates, 23 Oman, Kuwait, and Qatar that have among 24 their functional responsibilities maritime secu- 25 rity missions; and 26 VerDate Sep 11 2014 22:15 Apr 22, 2019 Jkt 089200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\H2280.IH H2280 kjohnson on DSK79L0C42 with BILLS 3 •HR 2280 IH (B) to provide training to ministry, agency, 1 and headquarters level organizations for such 2 forces. 3 (2) DESIGNATION.—The provision of assistance 4 and training under this section may be referred to 5 as the ‘‘Counter Iran Maritime Initiative’’. 6 (c) TYPES OF TRAINING.— 7 (1) AUTHORIZED ELEMENTS OF TRAINING.— 8 Training provided under subsection (b)(1)(A) may 9 include the provision of de minimis equipment, sup- 10 plies, and small-scale military construction. 11 (2) REQUIRED ELEMENTS OF TRAINING.— 12 Training provided under subsection (b) shall include 13 elements that promote the following: 14 (A) Observance of and respect for human 15 rights and fundamental freedoms. 16 (B) Respect for legitimate civilian author- 17 ity within the country to which the assistance 18 is provided. 19 (d) AVAILABILITY OF FUNDS.—Of the amount au- 20 thorized to be appropriated for fiscal year 2020 and avail- 21 able for operation and maintenance for Defense-wide ac- 22 tivities, $50,000,000 shall be available only for the provi- 23 sion of assistance and training under subsection (b). 24 (e) COST SHARING.— 25 VerDate Sep 11 2014 22:15 Apr 22, 2019 Jkt 089200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6201 E:\BILLS\H2280.IH H2280 kjohnson on DSK79L0C42 with BILLS 4 •HR 2280 IH (1) SENSE OF CONGRESS.—It is the sense of 1 Congress that, given income parity among recipient 2 countries, the Secretary of Defense, with the concur- 3 rence of the Secretary of State, should seek, through 4 appropriate bilateral and multilateral arrangements, 5 payments sufficient in amount to offset any training 6 costs associated with implementation of subsection 7 (b). 8 (2) COST-SHARING AGREEMENT.—The Sec- 9 retary of Defense, with the concurrence of the Sec- 10 retary of State, shall negotiate a cost-sharing agree- 11 ment with a recipient country regarding the cost of 12 any training provided pursuant to subsection (b). 13 The agreement shall set forth the terms of cost 14 sharing that the Secretary of Defense determines 15 are necessary and appropriate, but such terms shall 16 not be less than 50 percent of the overall cost of the 17 training. 18 (3) CREDIT TO APPROPRIATIONS.—The portion 19 of such cost sharing received by the Secretary of De- 20 fense pursuant to this subsection may be credited to- 21 wards appropriations available for operation and 22 maintenance for Defense-wide activities. 23 (f) NOTICE TO CONGRESS ON TRAINING.—Not later 24 than 15 days before exercising the authority under sub- 25 VerDate Sep 11 2014 22:15 Apr 22, 2019 Jkt 089200 PO 00000 Frm 00004 Fmt 6652 Sfmt 6201 E:\BILLS\H2280.IH H2280 kjohnson on DSK79L0C42 with BILLS 5 •HR 2280 IH section (b) with respect to a recipient country, the Sec- 1 retary of Defense shall submit to the appropriate congres- 2 sional committees a notification containing the following: 3 (1) An identification of the recipient country. 4 (2) A detailed justification of the program for 5 the provision of the training concerned, and its rela- 6 tionship to United States security interests. 7 (3) The budget for the program, including a 8 timetable of planned expenditures of funds to imple- 9 ment the program, an implementation timeline for 10 the program with milestones (including anticipated 11 delivery schedules for any assistance and training 12 under the program), the military department or 13 component responsible for management of the pro- 14 gram, and the anticipated completion date for the 15 program. 16 (4) A description of the arrangements, if any, 17 to support recipient country sustainment of any ca- 18 pability developed pursuant to the program, and the 19 source of funds to support sustainment efforts and 20 performance outcomes to be achieved under the pro- 21 gram beyond its completion date, if applicable. 22 (5) A description of the program objectives and 23 an assessment framework to be used to develop ca- 24 VerDate Sep 11 2014 22:15 Apr 22, 2019 Jkt 089200 PO 00000 Frm 00005 Fmt 6652 Sfmt 6201 E:\BILLS\H2280.IH H2280 kjohnson on DSK79L0C42 with BILLS 6 •HR 2280 IH pability and performance metrics associated with 1 operational outcomes for the recipient force. 2 (6) Such other matters as the Secretary con- 3 siders appropriate. 4 (g) DEFINITION.—In this section, the term ‘‘appro- 5 priate congressional committees’’ means— 6 (1) the Committee on Armed Services, the 7 Committee on Foreign Relations, and the Committee 8 on Appropriations of the Senate;
