following bill; which was referred to the Committee on Education and Labor
A BILL
To amend the Higher Education Act of 1965 to require
assurances by recipients of assistance under section
402B or 402C of that Act with respect to activities
for homeless children and youths and foster care children
and youth, and for other purposes.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

This Act may be cited as the ‘‘Removing Barriers to
4
Foster Youth Success in College Act’’.

SEC. 2. TALENT SEARCH.

Section 402B(d) of the Higher Education Act of
2
1965 (20 U.S.C. 1070a–12(d)) is amended—
3
(1) in paragraph (3), by striking ‘‘and’’ after
4
the semicolon;
5
(2) in paragraph (4), by striking the period at
6
the end and inserting a semicolon; and
7
(3) by adding at the end the following:
8
‘‘(5) require an assurance that the entity car-
9
rying out the project has reviewed and revised poli-
10
cies and practices as needed to remove barriers to
11
the participation and retention in the project of
12
homeless children and youths (as such term is de-
13
fined in section 725 of the McKinney-Vento Home-
14
less Assistance Act (42 U.S.C. 11434a)), including
15
unaccompanied youths, and foster care children and
16
youth;
17
‘‘(6) require that such entity submit, as part of
18
the application for the project, a description of the
19
activities that will be undertaken to reach out to
20
homeless children and youths and foster care chil-
21
dren and youth as part of the project; and
22
‘‘(7) require an assurance that such entity will
23
prepare and submit the report required under sec-
24
tion 402H(e) at the conclusion of the project regard-

SEC. 3. UPWARD BOUND.

Section 402C(e) of the Higher Education Act of 1965

(20 U.S.C. 1070a–13(e)) is amended—
5
(1) in paragraph (4), by striking ‘‘and’’ after

the end and inserting a semicolon; and

(3) by adding at the end the following:

SEC. 4. REPORTS AND EVALUATIONS.

Section 402H of the Higher Education Act of 1965
7
(20 U.S.C. 1070a–18) is amended by adding at the end
8
the following:
9
‘‘(e) REPORTS REGARDING HOMELESS CHILDREN
10
AND
YOUTHS
AND
FOSTER
CARE
CHILDREN
AND
11
YOUTH.—

‘‘(1) IN GENERAL.—Each entity carrying out a
13
project under section 402B or 402C shall, at the
14
conclusion of the project, prepare and submit a re-
15
port to the Secretary that includes—
16
‘‘(A) data on the number of homeless chil-
17
dren and youths (as such term is defined in sec-
18
tion 725 of the McKinney-Vento Homeless As-
19
sistance Act (42 U.S.C. 11434a)) and foster
20
care children and youth served through the
21
project; and
22
‘‘(B) a description of any strategies or pro-
23
gram enhancements that were used in the
24
project and that were effective in meeting the
25

needs of homeless children and youths and fos-

‘‘(2) REPORTS TO CONGRESS.—The Secretary
3
annually shall submit to the Congress a report sum-
4
marizing the information provided in the reports
5
submitted under paragraph (1).’’.
