Be it enacted by the Senate and House of Representa-
1
tives of the United States of America in Congress assembled,
2
SECTION 1. SHORT TITLE.
3
This Act may be cited as the ‘‘Land and Water Con-
4
servation Fund Permanent Funding Act’’.
5
SEC. 2. PERMANENT FULL FUNDING OF THE LAND AND
6
WATER CONSERVATION FUND.
7
(a) IN GENERAL.—Section 200303 of title 54, United
8
States Code, is amended to read as follows:
9
‘‘§ 200303. Availability of funds
10
‘‘(a) IN GENERAL.—For fiscal year 2020 and each
11
fiscal year thereafter, amounts deposited in the Fund
12
under section 200302 shall be made available for expendi-
13
ture, without further appropriation or fiscal year limita-
14
tion, to carry out the purposes of the Fund (including ac-
15
counts and programs made available from the Fund under
16
the Consolidated and Further Continuing Appropriations
17
Act, 2015 (Public Law 113–235; 128 Stat. 2130)).
18
‘‘(b) ADDITIONAL AMOUNTS.—Amounts made avail-
19
able under subsection (a) shall be in addition to amounts
20
made available to the Fund under section 105 of the Gulf
21
of Mexico Energy Security Act of 2006 (43 U.S.C. 1331
22
note; Public Law 109–432) or otherwise appropriated
23
from the Fund.

‘‘(c) ALLOCATION AUTHORITY.—

‘‘(1) SUBMISSION
OF
COST
ESTIMATES.—The
1
President shall submit to Congress detailed account,
2
program, and project allocations to be funded of the
3
full amount made available under subsection (a) as
4
part of the annual budget submission of the Presi-
5
dent.
6
‘‘(2) ALTERNATE ALLOCATION.—
7
‘‘(A) IN
GENERAL.—Appropriations Acts
8
may provide for alternate allocation of amounts
9
made available under subsection (a), including
10
allocations by account and program account,
11
program, and project.
12
‘‘(B) ALLOCATION BY PRESIDENT.—
13
‘‘(i) NO ALTERNATE ALLOCATIONS.—
14
If Congress has not enacted legislation es-
15
tablishing alternate allocations by the date
16
that is 120 days after the date on which
17
the applicable fiscal year begins, on which
18
the Act making appropriations for the De-
19
partment of the Interior, Environment, and
20
Related Agencies for the remainder of the
21
applicable fiscal year is enacted into law,
22
amounts made available under subsection
23
(a) shall be allocated by the President.

‘‘(ii) INSUFFICIENT
ALTERNATE
AL-

LOCATION.—If Congress enacts legislation
2
establishing
alternate
allocations
for
3
amounts made available under subsection
4
(a) that are less than the full amount ap-
5
propriated under that subsection, the dif-
6
ference between the amount appropriated
7
and the alternate allocation shall be allo-
8
cated by the President.
9
‘‘(3)
RECREATIONAL
PUBLIC
ACCESS.—
10
Amounts expended from the Fund under this section
11
shall be consistent with the requirements for rec-
12
reational public access for hunting, fishing, rec-
13
reational shooting, or other outdoor recreational pur-
14
poses under section 200306(c).
15
‘‘(4) ANNUAL
REPORT.—The President shall
16
submit to Congress an annual report that describes
17
the final allocation by account, program, and project
18
of amounts made available under subsection (a), in-
19
cluding a description of the status of obligations and
20
expenditures.’’.
21
(b) CONFORMING AMENDMENT.—Section 200302(c)
22
of title 54, United States Code, is amended by striking
23
paragraph (3).
