To direct the Secretaries of the military departments to submit certification
and a report each year to the Secretaries of Defense and Housing
and Urban Development regarding whether housing under the jurisdiction
of the Secretaries of the military departments is in compliance with
requirements relating to lead-based paint.

was referred to the Committee on Armed Services
A BILL
To direct the Secretaries of the military departments to
submit certification and a report each year to the Secre-
taries of Defense and Housing and Urban Development
regarding whether housing under the jurisdiction of the
Secretaries of the military departments is in compliance
with requirements relating to lead-based paint.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. ANNUAL CERTIFICATION AND REPORTING RE-

GARDING LEAD-BASED PAINT IN MILITARY
4
HOUSING.

(a) ANNUAL CERTIFICATION AND REPORTING.—

(1) IN
GENERAL.—Each Secretary concerned
1
shall submit certification in writing to the Secre-
2
taries of Defense and Housing and Urban Develop-
3
ment indicating whether housing under the jurisdic-
4
tion of the Secretary concerned is in compliance with
5
the requirements respecting lead-based paint, lead-
6
based paint activities, and lead-based paint hazards
7
described in section 408 of the Toxic Substances
8
Control Act (15 U.S.C. 2688).
9
(2) SUBMISSION DATES.—Each Secretary con-
10
cerned shall submit the certification under para-
11
graph (1) not later than July 31 of each year begin-
12
ning in 2019.

(3) CONTENTS.—Each certification under para-
14
graph (1) shall state, with regards to the preceding
15
calendar year—
16
(A) the total number of housing units
17
under the jurisdiction of the Secretary con-
18
cerned that were inspected for lead-based paint
19
in accordance with the requirements described
20
in paragraph (1);
21
(B) the total number of housing units that
22
were found to contain lead-based paint in the
23
course of the inspections described in subpara-
24
graph (A);

(C) any abatement efforts conducted re-
1
garding housing units described in subpara-
2
graph (B); and
3
(D) the total number of housing units
4
under the jurisdiction of the Secretary con-
5
cerned that were not inspected for lead-based
6
paint.

(b) ACCOUNTABILITY.—Not later than August 31 of
8
each year beginning in 2019, the Secretary of Defense
9
shall publish (including on a website of the Department
10
of Defense) and submit to the Armed Services Committee
11
and Appropriations Committee of the House of Represent-
12
atives and the Armed Services Committee and Appropria-
13
tions Committee of the Senate a report that discloses—
14
(1) each military department that has failed to
15
submit a required certification under subsection (a);
16
and
17
(2) a detailed summary of the data, broken
18
down by military department, contained in the cer-
19
tifications under subsection (a).
20
(c) NONCOMPLIANCE PENALTIES.—For each of fiscal
21
years 2019 through 2022, each political appointee of a
22
military department that has failed to certify compliance
23
under subsection (a) may not receive bonus pay, excluding

overtime pay, until the Secretary concerned certifies such

compliance.

(d) DEFINITIONS.—In this section, the terms ‘‘Sec-
3
retary concerned’’ and ‘‘military department’’ have the
4
meanings given those terms in section 101 of title 10,
5
United States Code.
