Be it enacted by the Senate and House of Representa- 1 tives of the United States of America in Congress assembled, 2 SECTION 1. LEAD LEVEL SCREENINGS AND TESTINGS FOR 3 CHILDREN. 4 (a) TRICARE.— 5 (1) WELL-BABY CARE.—Section 1077 of title 6 10, United States Code, is amended by adding at 7 the end the following new subsection: 8 VerDate Sep 11 2014 20:27 Apr 23, 2019 Jkt 089200 PO 00000 Frm 00001 Fmt 6652 Sfmt 6201 E:\BILLS\H2254.IH H2254 pamtmann on DSKBFK8HB2PROD with BILLS 2 •HR 2254 IH ‘‘(i)(1) Beginning January 1, 2019, in furnishing 1 well-baby care under subsection (a)(8), the Secretary shall 2 ensure that such care includes the following: 3 ‘‘(A) With respect to a child who lives in hous- 4 ing built before 1978 at any time during the first 24 5 months of the life of the child— 6 ‘‘(i) the first testing of the child for the 7 level of lead in the blood of the child at approxi- 8 mately the age of 12 months; and 9 ‘‘(ii) the second such test at approximately 10 the age of 24 months. 11 ‘‘(B) With respect to a child not covered by 12 subparagraph (A) whose parent or guardian, at any 13 time during the first 24 months of the life of the 14 child, has a military occupational specialty that the 15 Secretary determines poses an elevated risk of lead 16 exposure— 17 ‘‘(i) the first testing of the child for the 18 level of lead in the blood of the child at approxi- 19 mately the age of 12 months; and 3 ‘‘(ii) the second such screening at approxi- 4 mately the age of 24 months. 5 ‘‘(D) With respect to a child covered by sub- 6 paragraph (C) whose screening indicates an elevated 7 risk of lead exposure, testing of the child for the 8 level of lead in the blood of the child. 9 ‘‘(2) The Secretary shall ensure that any care pro- 10 vided to a child pursuant to this chapter for lead poisoning 11 shall be carried out in accordance with applicable advice 12 from the Centers for Disease Control and Prevention. 13 ‘‘(3)(A) With respect to a child who receives a test 14 under paragraph (1), the Secretary shall provide the re- 15 sults of the test to the parent or guardian of the child. 16 ‘‘(B) With respect to a child who receives a test under 17 paragraph (1), the Secretary shall provide the results of 18 the test and the address at which the child resides to— 19 ‘‘(i) the relevant health department of the State 20 in which the child resides if the child resides in the 21 United States; or 22 ‘‘(ii) the Centers for Disease Control and Pre- 23 vention if the child resides outside the United 24 States. 25 VerDate Sep 11 2014 20:27 Apr 23, 2019 Jkt 089200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6201 E:\BILLS\H2254.IH H2254 pamtmann on DSKBFK8HB2PROD with BILLS 4 •HR 2254 IH ‘‘(C) In providing information regarding a child to 1 a State or the Centers for Disease Control and Prevention 2 under subparagraph (B), the Secretary may not provide 3 any identifying information or health information of the 4 child that is not specifically authorized in such subpara- 5 graph. 6 ‘‘(D) In this paragraph, the term ‘State’ means each 7 of the several States, the District of Columbia, the Com- 8 monwealth of Puerto Rico, and any territory or possession 9 of the United States.’’. 10 (2) CONFORMING AMENDMENT.—Subsection 11 (a)(8) of such section is amended by striking ‘‘in- 12 cluding well-baby care that includes one screening of 13 an infant for the level of lead in the blood of the in- 14 fant’’ and inserting ‘‘including, in accordance with 15 subsection (i), well-baby care that includes screen- 16 ings and testings for lead exposure and lead poi- 17 soning’’. 18 (3) STUDY.—Not later than January 1, 2020, 19 the Secretary of Defense shall submit to the con- 20 gressional defense committees (as defined by section 21 101(a)(16) of title 10, United States Code) a report 22 detailing the following: 23 (A) The number of children who were test- 24 ed for the level of lead in the blood of the child 25 VerDate Sep 11 2014 20:27 Apr 23, 2019 Jkt 089200 PO 00000 Frm 00004 Fmt 6652 Sfmt 6201 E:\BILLS\H2254.IH H2254 pamtmann on DSKBFK8HB2PROD with BILLS 5 •HR 2254 IH pursuant to subparagraph (A) of subsection 1 (i)(1) of section 1077 of title 10, United States 2 Code, as added by subsection (a), and of such 3 number, the number who were found to have 4 elevated blood lead levels. 5 (B) The number of children who were test- 6 ed for the level of lead in the blood of the child 7 pursuant to subparagraph (B) of such sub- 8 section (i)(1), and of such number, the number 9 who were found to have lead poisoning. 10 (C) The number of children who were 11 screened for an elevated risk of lead exposure 12 pursuant to subparagraph (C) of such sub- 13 section (i)(1). 14 (D) The number of children who were test- 15 ed the level of lead in the blood of the child 16 pursuant to subparagraph (D) of such sub- 17 section, and of such number, the number who 18 were found to have elevated blood lead levels. 19 (E) The treatment provided to children 20 pursuant to chapter 55 of title 10, United 21 States Code, for lead poisoning. 22 (4) GAO REPORT.—Not later than January 1, 23 2021, the Comptroller General of the United States 24 shall submit to the congressional defense committees 25 VerDate Sep 11 2014 20:27 Apr 23, 2019 Jkt 089200 PO 00000 Frm 00005 Fmt 6652 Sfmt 6201 E:\BILLS\H2254.IH H2254 pamtmann on DSKBFK8HB2PROD with BILLS 6 •HR 2254 IH a report on the effectiveness of screening, testing, 1 and treating children for lead exposure and lead poi- 2 soning pursuant to chapter 55 of title 10, United 3 States Code. 4 (b) NOTIFICATION OF HOUSING.—Section 403 of 5 title 37, United States Code, is amended by adding at the 6 end the following new subsection: 7 ‘‘(p) RECORDS REGARDING HOUSING AND LEAD- 8 BASED PAINT.—(1) The Secretary concerned shall keep 9 a record of whether the following housing was built before, 10 during, or after 1978: 11 ‘‘(A) Quarters of the United States under the 12 jurisdiction of that Secretary concerned. 13 ‘‘(B) A housing facility under the jurisdiction of 14 that Secretary concerned. 15 ‘‘(C) Other housing in which a member of the 16 uniformed service of that Secretary concerned re- 17 sides. 18 ‘‘(2) As a condition of receipt of a basic allowance 19 for housing under this section, a member of the uniformed 20 services shall notify the Secretary concerned whether the 21 housing in which that member resides was built before, 22 during, or after 1978.’’. 23 Æ VerDate Sep 11 2014 20:27 Apr 23, 2019 Jkt 089200 PO 00000 Frm 00006 Fmt 6652 Sfmt 6301 E:\BILLS\H2254.IH H2254 pamtmann on DSKBFK8HB2PROD with BILLS
