A BILL
To direct the Secretary of Defense to establish a policy
relating to lead testing on military installations.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.
3
This Act may be cited as the ‘‘Integrity in Testing
4
for Lead in Military Housing Act of 2019’’.
5
SEC. 2. DEPARTMENT OF DEFENSE POLICY ON LEAD TEST-
6
ING ON MILITARY INSTALLATIONS.

(a) POLICY REQUIRED.—Not later than 180 days
8
after the date of the enactment of this Act, the Secretary
9
of Defense shall establish a policy under which—

(1) a qualified individual may access a military
1
installation for the purpose of conducting lead test-
2
ing on the installation, subject to the approval of the
3
Secretary; and
4
(2) the results of any lead testing conducted on
5
a military installation shall be transmitted—
6
(A) in the case of a military installation lo-
7
cated inside the United States, to relevant Fed-
8
eral, State, and local agencies; and
9
(B) in the case of a military installation lo-
10
cated outside the United States, to the Centers
11
for Disease Control and Prevention.

(b) PENALTIES.—As part of the policy established
13
under subsection (a), the Secretary of Defense shall pre-
14
scribe penalties for any member of the Armed Forces—
15
(1) who is responsible for transmitting the re-
16
sults of lead testing on a military installation to
17
Federal, State, and local agencies or to the Centers
18
for Disease Control and Prevention pursuant to the
19
policy, and who does not so transmit such results; or
20
(2) who impedes or obstructs the conduct of
21
lead testing on a military installation by a qualified
22
individual approved to conduct such testing pursuant
23
to the policy.

(c) RELATIONSHIP TO SECURITY MEASURES AND AC-
1
CESS STANDARDS.—Nothing in this section shall be con-
2
strued to supercede any Department of Defense or local
3
security measure or any access standard.
4
(d) DEFINITIONS.—In this section:
5
(1) The term ‘‘Armed Forces’’ has the meaning
6
given that term in section 101(a)(4) of title 10,
7
United States Code.
8
(2) The term ‘‘United States’’ has the meaning
9
given such term section 101(a)(1) of title 10, United
10
States Code.
11
(3) The term ‘‘qualified individual’’ means an
12
individual who is certified by the Environmental
13
Protection Agency or by a State as—
14
(A) a lead-based paint inspector; or
15
(B) a lead-based paint risk assessor.
