Be it enacted by the Senate and House of Representa- 1 tives of the United States of America in Congress assembled, 2 SECTION 1. HEALTH INSURANCE OF RESIDENTS OF UNITED 1 STATES TERRITORIES EXEMPT FROM AN- 2 NUAL FEE ON HEALTH INSURANCE PRO- 3 VIDERS. 4 (a) IN GENERAL.—Section 9010(b) of the Patient 5 Protection and Affordable Care Act is amended by adding 6 at the end the following new paragraph: 7 ‘‘(4) EXCEPTION FOR HEALTH INSURANCE OF 8 RESIDENTS OF UNITED STATES TERRITORIES.— 9 ‘‘(A) IN GENERAL.—Solely for purposes of 10 paragraph (1)(A), the term ‘United States 11 health risk’ shall not include the health risk of 12 any individual who is a bona fide resident of 13 Guam, American Samoa, the Northern Mariana 14 Islands, Puerto Rico, or the Virgin Islands (as 15 determined under section 937(a)). 16 ‘‘(B) EXCEPTION NOT TO INCREASE FEE 17 ALLOCATION.—The amount determined under 18 paragraph (1)(B) shall be determined without 19 regard to subparagraph (A) of this para- 20 graph.’’. 21 (b) REPORTING.—Section 9010(g)(1) of the Patient 22 Protection and Affordable Care Act is amended by insert- 23 ing ‘‘(and the amount of such net premiums to which sub- 24 section (b)(4)(A) applies)’’ before the period at the end. 25 (c) EFFECTIVE DATE.— 26 VerDate Sep 11 2014 01:28 Apr 20, 2019 Jkt 089200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\H2243.IH H2243 pamtmann on DSKBFK8HB2PROD with BILLS 3 •HR 2243 IH (1) IN GENERAL.—The amendments made by 1 this section shall apply to calendar years beginning 2 after the date of the enactment of this Act. 3 (2) TRANSITIONAL RULE FOR REPORTING.— 4 For purposes of applying the amendment made by 5 subsection (a) with respect to the first calendar year 6 beginning after the date of the enactment of this 7 Act, the Secretary of the Treasury (or the Sec- 8 retary’s designee) shall provide a method for covered 9 entities to report the information described in the 10 amendment made by subsection (b) for the calendar 11 year which precedes such first calendar year. 12 Æ VerDate Sep 11 2014 01:28 Apr 20, 2019 Jkt 089200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6301 E:\BILLS\H2243.IH H2243 pamtmann on DSKBFK8HB2PROD with BILLS
