To amend title 44, United States Code, to modernize the
Federal Register, and for other purposes.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.
3
This Act may be cited as the ‘‘Federal Register Mod-
4
ernization Act’’.
5
SEC. 2. FEDERAL REGISTER MODERNIZATION.
6
(a) REFERENCES TO PRINTING.—Chapter 15 of title
7
44, United States Code, is amended—
8
(1) in section 1502—

United States Code, is amended—

(1) by striking ‘‘; and’’ at the end of the defini-
17
tion for ‘‘person’’ and inserting a semicolon; and
18
(2) by inserting after the definition for ‘‘per-
19
son’’ the following:
20
‘‘ ‘publish’ means to circulate for sale or dis-
21
tribution to the public; and’’.

(c) FILING DOCUMENTS WITH OFFICE AMEND-
23
MENT.—Section 1503 of title 44, United States Code, is
24
amended to read as follows:

‘‘§ 1503. Filing documents with Office; notation of

time; public inspection; transmission for
2
publishing

‘‘The original document required or authorized to be
4
published by section 1505 shall be filed with the Office
5
of the Federal Register for publication at times estab-
6
lished by the Administrative Committee of the Federal
7
Register by regulation. The Archivist of the United States
8
shall cause to be noted on the original of each document
9
the day and hour of filing. Upon filing, the document shall
10
be immediately available for public inspection in the Of-
11
fice. The original shall be retained by the National Ar-
12
chives and Records Administration and shall be available
13
for inspection under regulations prescribed by the Archi-
14
vist, unless such original is disposed of in accordance with
15
disposal schedules submitted by the Administrative Com-
16
mittee and authorized by the Archivist pursuant to regula-
17
tions issued under chapter 33; however, originals of proc-
18
lamations of the President and Executive orders shall be
19
permanently retained by the Administration as part of the
20
National Archives of the United States. The Office shall
21
transmit to the Government Publishing Office, as provided
22
by this chapter, each document required or authorized to
23
be published by section 1505. Every Federal agency shall
24
cause to be transmitted for filing the original of all such

(d) FEDERAL
REGISTER
AMENDMENT.—Section
3
1504 of title 44, United States Code, is amended to read
4
as follows:
5
‘‘§ 1504. ‘Federal Register’; publishing; contents; dis-
6
tribution; price
7
‘‘Documents required or authorized to be published
8
by section 1505 shall be published immediately by the
9
Government Publishing Office in a serial publication des-
10
ignated the ‘Federal Register’. The Director of the Gov-
11
ernment Publishing Office shall make available the facili-
12
ties of the Government Publishing Office for the prompt
13
publication of the Federal Register in the manner and at
14
the times required by this chapter and the regulations pre-
15
scribed under it. The contents of the daily issues shall be
16
indexed and constitute all documents, required or author-
17
ized to be published, filed with the Office of the Federal
18
Register up to the time of the day immediately preceding
19
the day of publication fixed by regulations under this
20
chapter. There shall be published with each document a
21
copy of the notation, required to be made by section 1503,
22
of the day and hour when, upon filing with the Office,
23
the document was made available for public inspection.
24
Distribution shall be made at a time in the morning of

the day of distribution fixed by regulations prescribed

under this chapter. The prices to be charged for the Fed-
2
eral Register may be fixed by the Administrative Com-
3
mittee of the Federal Register established by section 1506
4
without reference to the restrictions placed upon and fixed
5
for the sale of Government publications by sections 1705
6
and 1708.’’.

(e) DOCUMENTS TO BE PUBLISHED IN THE FED-
8
ERAL REGISTER.—Section 1505 of title 44, United States
9
Code, is amended—
10
(1) in subsection (b)—
11
(A) in the heading, by striking ‘‘COM-
12
MENTS’’ and inserting ‘‘NEWS COMMENTARY’’;
13
and
14
(B) by striking ‘‘comments’’ and inserting
15
‘‘news commentary’’;
16
(2) by redesignating subsection (c) as sub-
17
section (d);
18
(3) by inserting after subsection (b) the fol-
19
lowing new subsection:
20
‘‘(c) ALTERNATIVE PUBLICATION.—In a continuity
21
of operations event in which the Government Publishing
22
Office does not fulfill the publication requirements of this
23
chapter, the Office of the Federal Register may establish
24
a website to publish the Federal Register until such time

that the Government Publishing Office resumes publica-

tion.’’; and
2
(4) in subsection (d), as so redesignated, in the
3
matter following paragraph (2)—
4
(A) by inserting ‘‘telecommunications, the
5
Internet,’’ after ‘‘the press, the radio,’’; and
6
(B) by striking ‘‘and two duplicate origi-
7
nals or two certified copies’’ and inserting ‘‘doc-
8
ument’’.

(f) ADMINISTRATIVE COMMITTEE OF THE FEDERAL
10
REGISTER AMENDMENT.—Subsection (a) of section 1506
11
of title 44, United States Code, is amended to read as
12
follows:
13
‘‘(a) COMPOSITION; DUTIES.—The Administrative
14
Committee of the Federal Register shall consist of the Ar-
15
chivist of the United States or Acting Archivist, who shall
16
chair the committee, an officer of the Department of Jus-
17
tice designated by the Attorney General, and the Director
18
of the Government Publishing Office or Acting Director
19
of the Government Publishing Office. The Director of the
20
Federal Register shall act as secretary of the committee.
21
The committee shall prescribe, with the approval of the
22
President, regulations for carrying out this chapter. The
23
regulations shall provide for, among other things—

‘‘(1) the documents which shall be authorized

under section 1505(b) to be published in the Federal
2
Register;
3
‘‘(2) the manner and form in which the Federal
4
Register shall be published;
5
‘‘(3) the manner and form in which agencies
6
submit documents for publication in the Federal
7
Register and special editions of the Federal Reg-
8
ister;
9
‘‘(4) subject to subsection (b), the manner of
10
distribution to Members of Congress, officers and
11
employees of the United States, or Federal agency,
12
for official use, and the number which shall be avail-
13
able for distribution to the public;
14
‘‘(5) the prices to be charged for individual cop-
15
ies of, and subscriptions to, the Federal Register
16
and any reprints and bound volumes of it;
17
‘‘(6) the manner and form by which the Federal
18
Register may receive information and comments
19
from the public, if practicable and efficient; and
20
‘‘(7) special editions of the Federal Register.’’.

MENT.—Section 1510 of title 44, United States Code, is

amended to read as follows:

‘‘§ 1510. Code of Federal Regulations

‘‘(a) SPECIAL EDITION FOR CODIFICATION OF AGEN-
2
CY DOCUMENTS.—The Administrative Committee of the
3
Federal Register, with the approval of the President, may
4
require, from time to time as it considers necessary, the
5
preparation and publication in a special edition of the Fed-
6
eral Register a complete codification of the documents of
7
each agency of the Government having general applica-
8
bility and legal effect, issued or promulgated by the agency
9
by publication in the Federal Register or by filing with
10
the Administrative Committee, and which are relied upon
11
by the agency as authority for, or are invoked or used by
12
it in the discharge of, its activities or functions, and are
13
in effect as to facts arising on or after dates specified by
14
the Administrative Committee.
15
‘‘(b) CODE OF FEDERAL REGULATIONS.—A codifica-
16
tion prepared under subsection (a) of this section shall be
17
published and shall be designated as the ‘Code of Federal
18
Regulations’. The Administrative Committee shall regu-
19
late the manner and forms of publishing this codification.
20
‘‘(c) SUPPLEMENTATION, COLLATION, AND REPUBLI-
21
CATION.—The Administrative Committee shall regulate
22
the supplementation and the collation and republication
23
of the codification with a view to keeping the Code of Fed-
24
eral Regulations as current as practicable. Each unit of
25
codification shall be supplemented and republished at least

once each calendar year. The Office of the Federal Reg-
1
ister may create updates of each unit of codification from
2
time to time and make the same available electronically
3
or may provide public access using an electronic edition
4
that allows a user to select a specific date and retrieve
5
the version of the codification in effect as of that date.
6
‘‘(d) PREPARATION AND PUBLICATION BY THE FED-
7
ERAL REGISTER.—The Office of the Federal Register
8
shall prepare and publish the codifications, supplements,
9
collations, indices, and user aids authorized by this sec-
10
tion.
11
‘‘(e) PRIMA FACIE EVIDENCE.—The codified docu-
12
ments of the several agencies published in the Code of
13
Federal Regulations under this section, as amended by
14
documents subsequently filed with the Office and pub-
15
lished in the daily issues of the Federal Register, shall
16
be prima facie evidence of the text of the documents and
17
of the fact that they are in effect on and after the date
18
of publication.
19
‘‘(f) REGULATIONS.—The Administrative Committee,
20
with approval of the President, shall issue regulations for
21
carrying out this section.
22
‘‘(g) EXCEPTION.—This section does not require
23
codification of the text of Presidential documents pub-

(h) TECHNICAL AND CONFORMING AMENDMENTS.—

The table of sections for chapter 15 of title 44, United

States Code, is amended by striking the items related to
5
sections 1502, 1503, and 1504 and inserting the following:

‘‘1502. Custody and publishing of Federal documents; appointment of Director.
‘‘1503. Filing documents with Office; notation of time; public inspection; trans-
mission for publishing.
‘‘1504. ‘Federal Register’; publishing; contents; distribution; price.’’.
SEC. 3. DETERMINATION OF BUDGETARY EFFECTS.

The budgetary effects of this Act, for the purpose of

complying with the Statutory Pay-As-You-Go-Act of 2010,
9
shall be determined by reference to the latest statement
10
titled ‘‘Budgetary Effects of PAYGO Legislation’’ for this
11
Act, submitted for printing in the Congressional Record
12
by the Chairman of the Senate Budget Committee, pro-
13
vided that such statement has been submitted prior to the
14
vote on passage.
