To amend part A of title IV of the Social Security Act
to clarify the authority of tribal governments in regard
to the Temporary Assistance for Needy Families pro-
gram.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

This Act may be cited as the ‘‘Tribal TANF Fairness
4
Act of 2019’’.

SEC. 2. SELF-DETERMINATION AUTHORITY.
6
Section 412 of the Social Security Act (42 U.S.C.
7
612) is amended by adding at the end the following:

‘‘(j) RULE OF INTERPRETATION.—Notwithstanding

subsection (e)(1), a tribal government (including a tribal
2
government participating in an intertribal consortium)
3
may lease land held in trust or in fee, at a fair market
4
rate (as verified by an independent appraisal prepared in
5
accordance with the Uniform Standards of Professional
6
Appraisal Practice), for the administration of a tribal fam-
7
ily assistance grant by the tribal government or the inter-
8
tribal consortium.’’.
