Be it enacted by the Senate and House of Representa- 1 tives of the United States of America in Congress assembled, 2 SECTION 1. SHORT TITLE. 3 This Act may be cited as the ‘‘Smart Building Accel- 4 eration Act’’. 5 SEC. 2. FINDINGS. 6 Congress finds that— 7 (1) the building sector uses more than 40 per- 8 cent of the energy of the United States; 9 VerDate Sep 11 2014 03:49 Apr 13, 2019 Jkt 089200 PO 00000 Frm 00001 Fmt 6652 Sfmt 6201 E:\BILLS\H2044.IH H2044 kjohnson on DSK79L0C42 with BILLS 2 •HR 2044 IH (2) emerging building energy monitoring and 1 control technologies are enabling a transition of the 2 building sector to ‘‘smart’’ buildings that have dra- 3 matically reduced energy use and improved quality 4 of service to occupants; 5 (3) an analysis of select private-sector smart 6 buildings by the Department of Energy would docu- 7 ment the costs and benefits of the emerging tech- 8 nologies, promote the adoption of the technologies, 9 and accelerate the transition to the technologies; 10 (4) with over 400,000 buildings, the Federal 11 Government is the largest building owner in the 12 United States; and 13 (5) the Federal Government can also accelerate 14 the transition to smart building technologies by dem- 15 onstrating and evaluating emerging smart building 16 technologies using existing programs and funding to 17 showcase selected Federal smart buildings. 18 SEC. 3. DEFINITIONS. 19 In this Act: 20 (1) DEPARTMENT.—The term ‘‘Department’’ 21 means the Department of Energy. 22 (2) PROGRAM.—The term ‘‘program’’ means 23 the Federal Smart Building Program established 24 under section 4(a). 25 VerDate Sep 11 2014 03:49 Apr 13, 2019 Jkt 089200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\H2044.IH H2044 kjohnson on DSK79L0C42 with BILLS 3 •HR 2044 IH (3) SECRETARY.—The term ‘‘Secretary’’ means 1 the Secretary of Energy. 2 (4) SMART BUILDING.—The term ‘‘smart build- 3 ing’’ means a building, or collection of buildings, 4 with an energy system that— 5 (A) is flexible and automated; 6 (B) has extensive operational monitoring 7 and communication connectivity, allowing re- 8 mote monitoring and analysis of all building 9 functions; 10 (C) takes a systems-based approach in in- 11 tegrating the overall building operations for 12 control of energy generation, consumption, and 13 storage; 14 (D) communicates with utilities and other 15 third-party commercial entities, if appropriate; 16 (E) protects the health and safety of occu- 17 pants and workers; and 18 (F) is cybersecure. 19 (5) SMART BUILDING ACCELERATOR.—The 20 term ‘‘smart building accelerator’’ means an initia- 21 tive that is designed to demonstrate specific innova- 22 tive policies and approaches— 23 (A) with clear goals and a clear timeline; 24 and 25 VerDate Sep 11 2014 03:49 Apr 13, 2019 Jkt 089200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6201 E:\BILLS\H2044.IH H2044 kjohnson on DSK79L0C42 with BILLS 4 •HR 2044 IH (B) that, on successful demonstration, 1 would accelerate investment in energy effi- 2 ciency. 3 (6) INTERNET OF THINGS TECHNOLOGY SOLU- 4 TION.—The term ‘‘internet of things technology so- 5 lution’’ means a solution that improves energy effi- 6 ciency and predictive maintenance through cutting 7 edge technologies that utilize internet connected 8 technologies including sensors, intelligent gateways, 9 and security embedded hardware. 10 SEC. 4. FEDERAL SMART BUILDING PROGRAM. 11 (a) ESTABLISHMENT.—Not later than 1 year after 12 the date of enactment of this Act, the Secretary shall, in 13 consultation with the Administrator of General Services, 14 establish a program to be known as the ‘‘Federal Smart 15 Building Program’’— 16 (1) to implement smart building technology; 17 and 18 (2) to demonstrate the costs and benefits of 19 smart buildings. 20 (b) SELECTION.— 21 (1) IN GENERAL.—The Secretary shall coordi- 22 nate the selection of not fewer than 1 building from 23 among each of several key Federal agencies, as de- 24 scribed in subsection (d), to compose an appro- 25 VerDate Sep 11 2014 03:49 Apr 13, 2019 Jkt 089200 PO 00000 Frm 00004 Fmt 6652 Sfmt 6201 E:\BILLS\H2044.IH H2044 kjohnson on DSK79L0C42 with BILLS 5 •HR 2044 IH priately diverse set of smart buildings based on size, 1 type, and geographic location. 2 (2) INCLUSION OF COMMERCIALLY OPERATED 3 BUILDINGS.—In making selections under paragraph 4 (1), the Secretary may include buildings that are 5 owned by the Federal Government but are commer- 6 cially operated. 7 (c) TARGETS.—Not later than 18 months after the 8 date of enactment of this Act, the Secretary shall establish 9 targets for the number of smart buildings to be commis- 10 sioned and evaluated by key Federal agencies by 3 years 11 and 6 years after the date of enactment of this Act. 12 (d) FEDERAL AGENCY DESCRIBED.—The key Fed- 13 eral agencies referred to subsection (b)(1) shall include 14 buildings operated by— 15 (1) the Department of the Army; 16 (2) the Department of the Navy; 17 (3) the Department of the Air Force; 18 (4) the Department; 19 (5) the Department of the Interior; 20 (6) the Department of Veterans Affairs; and 21 (7) the General Services Administration. 22 (e) REQUIREMENT.—In implementing the program, 23 the Secretary shall leverage existing financing mechanisms 24 VerDate Sep 11 2014 03:49 Apr 13, 2019 Jkt 089200 PO 00000 Frm 00005 Fmt 6652 Sfmt 6201 E:\BILLS\H2044.IH H2044 kjohnson on DSK79L0C42 with BILLS 6 •HR 2044 IH including energy savings performance contracts, utility en- 1 ergy service contracts, and annual appropriations. 2 (f) EVALUATION.—Using the guidelines of the Fed- 3 eral Energy Management Program relating to whole-build- 4 ing evaluation, measurement, and verification, the Sec- 5 retary shall evaluate the costs and benefits of the buildings 6 selected under subsection (b), including an identification 7 of— 8 (1) which advanced building technologies— 9 (A) are most cost-effective; and 10 (B) show the most promise for— 11 (i) increasing building energy savings; 12 (ii) increasing service performance to 13 building occupants; 14 (iii) reducing environmental impacts; 15 and 16 (iv) establishing cybersecurity; and 17 (2) any other information the Secretary deter- 18 mines to be appropriate. 19 (g) AWARDS.—The Secretary may expand awards 20 made under the Federal Energy Management Program 21 and the Better Building Challenge to recognize specific 22 agency achievements in accelerating the adoption of smart 23 building technologies. 24 VerDate Sep 11 2014 03:49 Apr 13, 2019 Jkt 089200 PO 00000 Frm 00006 Fmt 6652 Sfmt 6201 E:\BILLS\H2044.IH H2044 kjohnson on DSK79L0C42 with BILLS 7 •HR 2044 IH SEC. 5. SURVEY OF PRIVATE SECTOR SMART BUILDINGS. 1 (a) SURVEY.—The Secretary shall conduct a survey 2 of privately owned smart buildings throughout the United 3 States, including commercial buildings, laboratory facili- 4 ties, hospitals, multifamily residential buildings, and build- 5 ings owned by nonprofit organizations and institutions of 6 higher education. 7 (b) SELECTION.—From among the smart buildings 8 surveyed under subsection (a), the Secretary shall select 9 not fewer than 1 building each from an appropriate range 10 of building sizes, types, and geographic locations. 11 (c) EVALUATION.—Using the guidelines of the Fed- 12 eral Energy Management Program relating to whole-build- 13 ing evaluation, measurement, and verification, the Sec- 14 retary shall evaluate the costs and benefits of the buildings 15 selected under subsection (b), including an identification 16 of— 17 (1) which advanced building technologies and 18 systems— 19 (A) are most cost-effective; and 20 (B) show the most promise for— 21 (i) increasing building energy savings; 22 (ii) increasing service performance to 23 building occupants; 24 (iii) reducing environmental impacts; 25 and 26 VerDate Sep 11 2014 03:49 Apr 13, 2019 Jkt 089200 PO 00000 Frm 00007 Fmt 6652 Sfmt 6201 E:\BILLS\H2044.IH H2044 kjohnson on DSK79L0C42 with BILLS 8 •HR 2044 IH (iv) establishing cybersecurity; and 1 (2) any other information the Secretary deter- 2 mines to be appropriate. 3 SEC. 6. LEVERAGING EXISTING PROGRAMS. 4 (a) BETTER BUILDING CHALLENGE.—As part of the 5 Better Building Challenge of the Department, the Sec- 6 retary, in consultation with major private sector property 7 owners, shall develop smart building accelerators to dem- 8 onstrate innovative policies and approaches that will accel- 9 erate the transition to smart buildings in the public, insti- 10 tutional, and commercial buildings sectors. 11 (b) RESEARCH AND DEVELOPMENT.— 12 (1) IN GENERAL.—The Secretary shall conduct 13 research and development to address key barriers to 14 the integration of advanced building technologies 15 and to accelerate the transition to smart buildings. 16 (2) INCLUSION.—The research and development 17 conducted under paragraph (1) shall include re- 18 search and development on— 19 (A) achieving whole-building, systems-level 20 efficiency through smart system and component 21 integration; 22 (B) improving physical components, such 23 as sensors and controls, to be adaptive, antici- 24 patory, and networked; 25 VerDate Sep 11 2014 03:49 Apr 13, 2019 Jkt 089200 PO 00000 Frm 00008 Fmt 6652 Sfmt 6201 E:\BILLS\H2044.IH H2044 kjohnson on DSK79L0C42 with BILLS 9 •HR 2044 IH (C) reducing the cost of key components to 1 accelerate the adoption of smart building tech- 2 nologies; 3 (D) data management, including the cap- 4 ture and analysis of data and the interoper- 5 ability of the energy systems; 6 (E) protecting against cybersecurity 7 threats and addressing security vulnerabilities 8 of building systems or equipment; 9 (F) business models, including how busi- 10 ness models may limit the adoption of smart 11 building technologies and how to support 12 transactive energy; 13 (G) integration and application of com- 14 bined heat and power systems and energy stor- 15 age for resiliency; 16 (H) characterization of buildings and com- 17 ponents; 18 (I) consumer and utility protections; 19 (J) continuous management, including the 20 challenges of managing multiple energy systems 21 and optimizing systems for disparate stake- 22 holders; 23 (K) integration of internet of things tech- 24 nology solutions, including measures to increase 25 VerDate Sep 11 2014 03:49 Apr 13, 2019 Jkt 089200 PO 00000 Frm 00009 Fmt 6652 Sfmt 6201 E:\BILLS\H2044.IH H2044 kjohnson on DSK79L0C42 with BILLS 10 •HR 2044 IH water and energy efficiency, improve water 1 quality, support real-time utility management, 2 and enable actionable analytics and predictive 3 maintenance to improve building systems long- 4 term viability; and 5 (L) other areas of research and develop- 6 ment, as determined appropriate by the Sec- 7 retary. 8 SEC. 7. REPORT. 9 Not later than 2 years after the date of enactment 10 of this Act, and every 2 years thereafter until a total of 11 3 reports have been made, the Secretary shall submit to 12 the Committee on Energy and Natural Resources of the 13 Senate and the Committee on Energy and Commerce and 14 the Committee on Science, Space, and Technology of the 15 House of Representatives a report on— 16 (1) the establishment of the Federal Smart 17 Building Program and the evaluation of Federal 18 smart buildings under section 4; 19 (2) the survey and evaluation of private sector 20 smart buildings under section 5; and 21 (3) any recommendations of the Secretary to 22 further accelerate the transition to smart buildings. 23 Æ VerDate Sep 11 2014 03:49 Apr 13, 2019 Jkt 089200 PO 00000 Frm 00010 Fmt 6652 Sfmt 6301 E:\BILLS\H2044.IH H2044 kjohnson on DSK79L0C42 with BILLS
