appropriations certain services relating to the Federal Employees Health

To amend title 5, United States Code, to clarify that during
a lapse in appropriations certain services relating to the
Federal Employees Health Benefits Program are ex-
cepted services under the Anti-Deficiency Act, and for
other purposes.
Be it enacted by the Senate and House of Representa-

SECTION 1. SHORT TITLE.

This Act may be cited as the ‘‘Ensuring FEHBP
4
Coverage During Shutdowns Act’’.

SEC. 2. DESIGNATING CERTAIN FEHBP-RELATED SERVICES

AS EXCEPTED SERVICES UNDER THE ANTI-
2
DEFICIENCY ACT.

(a) IN GENERAL.—Section 8905 of title 5, United
4
States Code, is amended by adding at the end the fol-
5
lowing:
6
‘‘(i) Any services by an officer or employee under this
7
chapter relating to enrolling individuals in a health bene-
8
fits plan under this chapter, or changing the enrollment
9
of an individual already so enrolled due to a qualifying
10
life event, shall be deemed, for purposes of section 1342
11
of title 31, services for emergencies involving the safety
12
of human life or the protection of property.’’.

(b) APPLICATION.—The amendment made by sub-
14
section (a) shall apply to any lapse in appropriations be-
15
ginning on or after the date of enactment of this Act.
