SHORT TITLE. 3 This Act may be cited as ‘‘An Act Targeting Re- 4 sources to Communities in Need’’. 5 SEC. 2. DEFINITIONS. 6 In this Act: 7 (1) DEVELOPMENT PROGRAM.—The term ‘‘de- 8 velopment program’’ means any of the following pro- 9 grams, offices, or appropriations accounts: 10 (A) Any program administered by the Of- 11 fice of Rural Development of the Department of 12 Agriculture. 13 (B) The Appalachian Regional Commis- 14 sion. 15 (C) Department of Commerce, Economic 16 Development Administration, Economic Devel- 17 opment Assistance Programs. 18 (D) The Delta Regional Authority. 19 (E) The Denali Commission. 20 (F) Any training or employment services 21 program administered by bus Crime Control and Safe Streets Act of 7 1968 (34 U.S.C. 10511 et seq.). 8 (Q) A grant program for community-based 9 sexual assault response reform grants under 10 part T of the Omnibus Crime Control and Safe 11 Streets Act of 1968 (34 U.S.C. 10441et seq.). 12 (R) The court-appointed special advocate 13 program, as authorized by section 217 of the 14 Crime Control Act of 1990 (34 U.S.C. Border Regional Com- 5 mission. 6 (EE) The Southwest Border Regional 7 Commission. 8 (FF) The Northern Great Plains Regional 9 Authority. 10 (GG) The Fair Housing Initiatives Pro- 11 gram under section 561 of the Housing and 12 Community Development Act of 1987 (42 13 U.S.C. 3616a). 14 (HH) The grant program under section 15 4611 of the Elementary and Secondary Edu- 16 cation Act of 1965 (20 U.S.C. 7261). 17 (2) PERSISTENT POVERTY COUNTY.—The term 18 ‘‘persistent poverty county’’ means any county with 19 a poverty rate of at least 20 percent, as determined 20 in each of the 1990 and 2000 decennial censuses, 21 and in the Bureau of the Census’s Small Area In- 22 come and Poverty Estimates for the most recent 23 year for which the estimates are available. 24 VerDate Sep 11 2014 04:32 census tract with a poverty 2 rate of at least 20 percent during the 5 years most 3 recently ending before the date of the enactment of 4 this Act. 5 SEC. 3. 10–20–30 FORMULA FOR PERSISTENT POVERTY 6 COUNTIES. 7 Notwithstanding any other provision of law, the enti- 8 ty responsible for administering a development program 9 shall use not less than 10 percent of the amounts made 10 available in any appropriations Act for the program for 11 any of fiscal years 2019 through 2028, in persistent pov- 12 erty counties, if the entity is otherwise authorized to do 13 so. 14 SEC. 4. TARGETING HIGH-POVERTY CENSUS TRACTS. 15 (a) IN GENERAL.—Notwithstanding any other provi- 16 sion of law, the entity responsible for administering a de- 17 velopment program shall use not less than the amount de- 18 scribed in subsection (b) of the amounts made available 19 in any appropriations Act for the program for any of fiscal 20 years 2019 through 2028, for projects in high-poverty 21 areas, if the entity is otherwise authorized to do so. 22 (b) AMOUNT DESCRIBED.—The amount described in 23 this subsection with respect to a program is an amount 24 equal to the sum of— 25 VerDate Sep 11 2014 04:32 Apr 13, 2019 Jkt 089200 PO 00000 Frm 00007 Fmt 6652 Sfmt 6201 E:\BILLS\H2055.IH H2055 kjohnson on DSK79L0C42 with BILLS 8 •HR 2055 IH (1) the average percentage of Federal assist- 1 ance awarded under the program in the 3 fiscal 2 years most recently ending before the date of the en- 3 actment of this Act that were used for projects in 4 high-poverty areas; plus 5 (2) 5 percent of the average total Federal loan 6 and grant funds awarded under the program in the 7 3 fiscal years referred to in paragraph (1). 8 (c) REPORT TO CONGRESS.—If an entity responsible 9 for administering a development program determines that 10 the provision of benefits under the program in a particular 11 census tract actually benefits individuals predominantly 12 living in other census tracts, then the entity shall, within 13 3 months after the date of the enactment of this Act, in- 14 form the Director of the Office of Management and Budg- 15 et and the Congress that it would be more appropriate 16 to track the provision of benefits under the program based 17 on the census tracts in which the individuals who actually 18 receive the benefits reside and on whether the benefits 19 serve individuals who reside in predominantly low-income 20 census tracts. 21 SEC. 5.
