Mr. LATTA (for himself and Mr. WELCH) introduced the following bill; which
was referred to the Committee on Energy and Commerce
A BILL
To clarify that no express or implied warranty is provided
by reason of a disclosure relating to voluntary participa-
tion in the Energy Star program, and for other purposes.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.
3
This Act may be cited as the ‘‘Energy Star Program
4
Integrity Act’’.
5
SEC. 2. NO WARRANTY.
6
Section 324A of the Energy Policy and Conservation
7
Act (42 U.S.C. 6294a) is amended by adding at the end
8
the following new subsection:

‘‘(e) NO WARRANTY.—
1
‘‘(1) IN GENERAL.—Any disclosure relating to
2
participation of a product in the Energy Star pro-
3
gram shall not create an express or implied warranty
4
or give rise to any private claims or rights of action
5
under State or Federal law relating to the disquali-
6
fication of that product from Energy Star if—
7
‘‘(A) the product has been certified by a
8
certification body recognized by the Energy
9
Star program;
10
‘‘(B) the Administrator has approved cor-
11
rective measures, including a determination of
12
whether or not consumer compensation is ap-
13
propriate; and
14
‘‘(C) the responsible party has fully com-
15
plied with all approved corrective measures.
16
‘‘(2) CONSTRUAL.—Nothing in this subsection
17
shall be construed to require the Administrator to
18
modify any procedure or take any other action.’’.
