A BILL
To direct the Administrator of the Environmental Protection
Agency to set a health-protective numerical emission limi-
tation for hydrogen cyanide under section 112 of the
Clean Air Act (42 U.S.C. 7412), and for other purposes.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.
3
This Act may be cited as the ‘‘Protecting Commu-
4
nities from Hydrogen Cyanide Act of 2019’’.

SEC. 2. PROTECTING PUBLIC HEALTH FROM HYDROGEN

CYANIDE POLLUTION.
2
Section 112(n) of the Clean Air Act (42 U.S.C.
3
7412(n)) is amended by adding at the end the following:
4
‘‘(8) HYDROGEN CYANIDE.—
5
‘‘(A) NUMERICAL EMISSION LIMITATION.—
6
The Administrator shall, by regulation—
7
‘‘(i) set a numerical emission limita-
8
tion for hydrogen cyanide from petroleum
9
refineries; and
10
‘‘(ii) require—
11
‘‘(I) real-time fenceline air moni-
12
toring of emissions of hydrogen cya-
13
nide at each petroleum refinery and
14
real-time online public reporting of
15
such monitoring;
16
‘‘(II) a community release alert
17
system for residents exposed to emis-
18
sions of hydrogen cyanide from a pe-
19
troleum refinery; and
20
‘‘(III) regular electronic report-
21
ing to the Administrator of all moni-
22
toring data related to emissions of hy-
23
drogen cyanide from each petroleum
24
refinery.

‘‘(B) REQUIREMENTS.—In setting a nu-
1
merical emission limitation under subparagraph
2
(A), the Administrator shall—
3
‘‘(i) require the maximum degree of
4
reduction in emissions that the Adminis-
5
trator determines is achievable, in accord-
6
ance with subsection (d);
7
‘‘(ii) ensure an ample margin of safety
8
to protect public health and prevent an ad-
9
verse environmental effect;
10
‘‘(iii) prevent adverse cumulative ef-
11
fects to fetal health, children’s health, and
12
the health of vulnerable subpopulations;
13
‘‘(iv) consider the effects and risks of
14
exposure to hydrogen cyanide from mul-
15
tiple sources and in combination with expo-
16
sure to other pollutants; and
17
‘‘(v)
consider
the
best
available
18
science, including as provided by the Na-
19
tional Academy of Sciences.

‘‘(C) REGULATION.—
21
‘‘(i) INITIAL REGULATION.—
22
‘‘(I) DEADLINE.—The Adminis-
23
trator shall promulgate the initial reg-
24
ulation required under subparagraph

(A) not later than 2 years after the
1
date of enactment of this paragraph.
2
‘‘(II) COMPLIANCE
DATE.—The
3
compliance date for the initial regula-
4
tion required under subparagraph (A)
5
shall be not later than 3 years after
6
the date of enactment of this para-
7
graph.
8
‘‘(ii) PUBLIC
HEARINGS.—Before fi-
9
nalizing a regulation (or revision thereof)
10
required under subparagraph (A), the Ad-
11
ministrator shall hold at least 2 public
12
hearings in communities exposed to air
13
pollution from petroleum refineries.
14
‘‘(D) SAVINGS CLAUSE.—Nothing in this
15
paragraph shall be interpreted to preclude or
16
deny the right of the Administrator or any
17
State or political subdivision thereof to adopt or
18
enforce emission standards, monitoring, or
19
other requirements that are more stringent
20
than the requirements herein.’’.
