To amend title 38, United States Code, to authorize the Secretary of Veterans
Affairs to pay educational assistance or subsistence allowances to certain
individuals during school term, quarter, or semester breaks.

Mr. CISNEROS introduced the following bill; which was referred to the
Committee on Veterans’ Affairs
A BILL
To amend title 38, United States Code, to authorize the
Secretary of Veterans Affairs to pay educational assist-
ance or subsistence allowances to certain individuals dur-
ing school term, quarter, or semester breaks.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

This Act may be cited as the ‘‘Break Relief for Every
4
Academic Kind of Period in an Academic Year for Vet-
5
erans Act’’ or the ‘‘BREAK PAY for Veterans Act’’.

SEC. 2. PAYMENT OF EDUCATIONAL ASSISTANCE OR SUB-

SISTENCE ALLOWANCES TO CERTAIN INDI-
2
VIDUALS DURING SEMESTER BREAKS.

Section 3680(a)(2) of title 38, United States Code,
4
is amended—
5
(1) in subparagraph (A), by striking ‘‘; or’’ and
6
inserting a semicolon;
7
(2) in subparagraph (B)(ii), by striking ‘‘dis-
8
approval.’’ and inserting ‘‘disapproval; or’’; and
9
(3) by adding at the end the following new sub-
10
paragraph:

‘‘(C) during periods between school terms,
12
quarters, or semesters where the educational institu-
13
tion certifies the enrollment of the eligible veteran or
14
eligible person on an individual term basis if—
15
‘‘(i) the period between those terms, quar-
16
ters, or semesters does not exceed eight weeks;
17
and
18
‘‘(ii) both terms, quarters, or semesters im-
19
mediately preceding and immediately following
20
the period are not shorter in length than the
21
period.’’.
