DUTIES OF SMALL BUSINESS DEVELOPMENT CEN- 1 TER COUNSELORS. 2 (a) CYBER TRAINING.—Section 21 of the Small Busi- 3 ness Act (15 U.S.C. 648) is amended by adding at the 4 end the following: 5 ‘‘(o) CYBER STRATEGY TRAINING FOR SMALL BUSI- 6 NESS DEVELOPMENT CENTERS.— 7 ‘‘(1) DEFINITIONS.—In this subsection— 8 ‘‘(A) the term ‘cyber strategy’ means re- 9 sources and tactics to assist in planning for cy- 10 bersecurity and defending against cyber risks 11 and attacks; and 12 ‘‘(B) the term ‘lead small business develop- 13 ment center’ means a small business develop- 14 ment center that has received a grant from the 15 Administration. 16 ‘‘(2) CERTIFICATION PROGRAM.—The Adminis- 17 trator shall establish a cyber counseling certification 18 program, or designate a substantially similar exist- 19 ing program, to certify the employees of lead small 20 business development centers in providing cyber 21 planning assistance to small business concerns. 22 ‘‘(3) NUMBER OF CERTIFIED EMPLOYEES.— 23 The Administrator shall ensure that the number of 24 employees of each lead small business development 25 VerDate Sep 11 2014 23:17 Apr 01, 2019 Jkt 089200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\S771.RS S771 pamtmann on DSKBFK8HB2PROD with BILLS 3 •S 771 RS center who are certified in providing cyber planning 1 assistance is not less than the lesser of— 2 ‘‘(A) 5; or 3 ‘‘(B) 10 percent of the total number of em- 4 ployees of the lead small business development 5 center. 6 ‘‘(4) CYBER STRATEGY.—In carrying out para- 7 graph (2), the Administrator, to the extent prac- 8 ticable, shall consider any cyber strategy methods in- 9 cluded in the Small Business Development Center 10 Cyber Strategy developed under section 11 1841(a)(3)(B) of the National Defense Authoriza- 12 tion Act for Fiscal Year 2017 (Public Law 114– 13 328). 14 ‘‘(5) REIMBURSEMENT FOR CERTIFICATION.— 15 ‘‘(A) IN GENERAL.—Subject to the avail- 16 ability of appropriations, the Administrator 17 shall reimburse a lead small business develop- 18 ment center for costs relating to the certifi- 19 cation of an employee of the lead small business 20 center in providing cyber planning assistance 21 under the program established under paragraph 22 (2). 23 ‘‘(B) LIMITATION.—The total amount re- 24 imbursed by the Administrator under subpara- 25 VerDate Sep 11 2014 23:17 Apr 01, 2019 Jkt 089200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6201 E:\BILLS\S771.RS S771 pamtmann on DSKBFK8HB2PROD with BILLS 4 •S 771 RS graph (A) may not exceed $350,000 in any fis- 1 cal year.’’. 2 (b) IMPLEMENTATION.—Not later than 180 days 3 after the date of enactment of this Act, the Administrator 4 of the Small Business Administration shall implement 5 paragraphs (2), (3), and (4) of section 21(o) of the Small 6 Business Act, as added by subsection (a). 7 VerDate Sep 11 2014 23:17 Apr 01, 2019 Jkt 089200 PO 00000 Frm 00004 Fmt 6652 Sfmt 6201 E:\BILLS\S771.RS S771 pamtmann on DSKBFK8HB2PROD with BILLS VerDate Sep 11 2014 23:17 Apr 01, 2019 Jkt 089200 PO 00000 Frm 00005 Fmt 6652 Sfmt 6201 E:\BILLS\S771.RS S771 pamtmann on DSKBFK8HB2PROD with BILLS Calendar No. 51 116TH CONGRESS 1ST SESSION S. 771 A BILL To amend section 21 of the Small Business Act to require cyber certification for small business de- velopment center counselors, and for other pur- poses.
