For the relief of Shirley Constantino Tan.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. PERMANENT RESIDENT STATUS FOR SHIRLEY
3
CONSTANTINO TAN.
4
(a) IN GENERAL.—Notwithstanding subsections (a)
5
and (b) of section 201 of the Immigration and Nationality
6
Act (8 U.S.C. 1151), Shirley Constantino Tan shall be eli-
7
gible for issuance of an immigrant visa or for adjustment
8
of status to that of an alien lawfully admitted for perma-
9
nent residence upon filing an application for issuance of
10
an immigrant visa under section 204 of such Act (8

(b)
ADJUSTMENT
OF
STATUS.—If
Shirley
3
Constantino Tan enters the United States before the filing
4
deadline specified in subsection (c), she shall be considered
5
to have entered and remained lawfully and shall be eligible
6
for adjustment of status under section 245 of the Immi-
7
gration and Nationality Act (8 U.S.C. 1255) as of the date
8
of the enactment of this Act.
9
(c) APPLICATION AND PAYMENT OF FEES.—Sub-
10
sections (a) and (b) shall apply only if the application for
11
issuance of an immigrant visa or the application for ad-
12
justment of status is filed with appropriate fees within two
13
years after the date of the enactment of this Act.

(d) REDUCTION OF IMMIGRANT VISA NUMBER.—
15
Upon the granting of an immigrant visa or permanent res-
16
idence to Shirley Constantino Tan, the Secretary of State
17
shall instruct the proper officer to reduce by one, during
18
the current or next following fiscal year—
19
(1) the total number of immigrant visas that
20
are made available to natives of the country of birth
21
of Shirley Constantino Tan under section 203(a) of
22
the Immigration and Nationality Act (8 U.S.C.
23
1153(a)); or

(2) if applicable, the total number of immigrant

visas that are made available to natives of the coun-
2
try of birth of Shirley Constantino Tan under sec-
3
tion 202(e) of such Act (8 U.S.C. 1152(e)).

(e) PAYGO.—The budgetary effects of this Act, for
5
the purpose of complying with the Statutory Pay-As-You-
6
Go Act of 2010, shall be determined by reference to the
7
latest statement titled ‘‘Budgetary Effects of PAYGO
8
Legislation’’ for this Act, submitted for printing in the
9
Congressional Record by the Chairman of the Senate
10
Budget Committee, provided that such statement has been
11
submitted prior to the vote on passage.
