CLARIFICATION REGARDING THE CHILDREN TO 1 WHOM ENTITLEMENT TO EDUCATIONAL AS- 2 SISTANCE MAY BE TRANSFERRED UNDER 3 THE POST-9/11 EDUCATIONAL ASSISTANCE 4 PROGRAM. 5 (a) IN GENERAL.—Section 3319(c) of title 38, 6 United States Code, is amended to read as follows: 7 ‘‘(c) ELIGIBLE DEPENDENTS.— 8 ‘‘(1) TRANSFER.—An individual approved to 9 transfer an entitlement to educational assistance 10 under this section may transfer the individual’s enti- 11 tlement as follows: 12 ‘‘(A) To the individual’s spouse. 13 ‘‘(B) To one or more of the individual’s 14 children. 15 ‘‘(C) To a combination of the individuals 16 referred to in subparagraphs (A) and (B). 17 ‘‘(2) DEFINITION OF CHILDREN.—For purposes 18 of this subsection, the term ‘children’ includes de- 19 pendents described in section 1072(2)(I) of title 20 10.’’. 21 (b) APPLICABILITY.—The amendment made by sub- 22 section (a) shall apply with respect to educational assist- 23 ance payable under chapter 33 of such title before, on, 24 or after the date of the enactment of this Act. 25 Æ VerDate Sep 11 2014 01:09 Mar 30, 2019 Jkt 089200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6301 E:\BILLS\S791.IS S791 kjohnson on DSK79L0C42 with BILLS
