To exempt certain motor carriers engaged in agricultural
business from the electronic logging device requirements,
and for other purposes.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

This Act may be cited as the ‘‘Agricultural Business
4
Electronic Logging Device Exemption Act of 2019’’.

SEC. 2. EXCEPTION TO THE ELECTRONIC LOGGING DEVICE

REQUIREMENTS FOR CERTAIN MOTOR CAR-
2
RIERS ENGAGED IN AGRICULTURAL BUSI-
3
NESS.

Section 31137(b)(3) of title 49, United States Code,
5
is amended to read as follows:
6
‘‘(3) EXCEPTION.—
7
‘‘(A) IN
GENERAL.—An excepted motor
8
carrier may comply with the hours of service re-
9
quirements by requiring each driver to use—
10
‘‘(i) a paper record of duty status
11
form; or
12
‘‘(ii) an electronic logging device.

‘‘(B) EXCEPTED
MOTOR
CARRIER
DE-
14
FINED.—In this paragraph, the term ‘excepted
15
motor carrier’ means—
16
‘‘(i) a motor carrier when transporting
17
a motor home or recreation vehicle trailer
18
within
the
definition
of
the
term
19
‘driveaway-towaway operation’ (as defined
20
in section 390.5 of title 49, Code of Fed-
21
eral Regulations);
22
‘‘(ii) a motor carrier when—
23
‘‘(I) transporting an agricultural
24
product (as defined in section 207 of
25
the Agricultural Marketing Act of

1946 (7 U.S.C. 1626)) from the

source of such product; or
2
‘‘(II) returning empty to such
3
source; and
4
‘‘(iii) a motor carrier when—
5
‘‘(I) transporting farm supplies
6
for agricultural purposes (as defined
7
in section 395.2 of title 49, Code of
8
Federal Regulations) from the dis-
9
tribution point for such farm supplies;
10
or
11
‘‘(II) returning empty to such
12
distribution point.’’.

SEC. 3. REQUIREMENT TO PRESCRIBE REGULATIONS.
14
Not later than 90 days after the date of enactment
15
of this Act, the Secretary of Transportation shall promul-
16
gate such regulations as are necessary to carry out the
17
amendment made by section 2 of this Act.
