following bill; which was referred to the Committee on Energy and Commerce
A BILL
To require the Federal Communications Commission to make
the provision of Wi-Fi access on school buses eligible
for E-rate support.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. E-RATE SUPPORT FOR SCHOOL BUS WI-FI.

(a) RULEMAKING.—
4
(1) IN
GENERAL.—Not later than 180 days
5
after the date of the enactment of this Act, the
6
Commission shall commence a rulemaking to make
7
the provision of Wi-Fi access on school buses eligible
8
for support under the E-rate program of the Com-

mission set forth under subpart F of part 54 of title

(2) ELIGIBLE
RECIPIENTS.—Notwithstanding
3
section 254(h)(1)(B) of the Communications Act of
4
1934 (47 U.S.C. 254(h)(1)(B)), the Commission
5
shall provide in the rulemaking under paragraph (1)
6
for State educational agencies, educational service
7
agencies, and local educational agencies to be eligible
8
to receive the support described in such paragraph.

(b) DEFINITIONS.—In this section:
10
(1) COMMISSION.—The term ‘‘Commission’’
11
means the Federal Communications Commission.

(2) SCHOOL
BUS.—The term ‘‘school bus’’
13
means a passenger motor vehicle that is—
14
(A) designed to carry a driver and not less
15
than 5 passengers; and
16
(B) used significantly to transport—
17
(i) children enrolled in an early child-
18
hood education program to or from such
19
program or an event related to such pro-
20
gram; or
21
(ii) students enrolled in an elementary
22
school or secondary school to or from such
23
school or an event related to such school.

ONDARY
EDUCATION
ACT
OF
1965.—The terms
2
‘‘early childhood education program’’, ‘‘educational
3
service agency’’, ‘‘elementary school’’, ‘‘local edu-
4
cational agency’’, ‘‘secondary school’’, and ‘‘State
5
educational agency’’ have the meanings given such
6
terms in section 8101 of the Elementary and Sec-
7
ondary Education Act of 1965 (20 U.S.C. 7801).
