PRE-EXPOSURE PROPHYLAXIS PROGRAM GRANT. 1 (a) IN GENERAL.—Not later than 1 year after the 2 date of enactment of this Act, the Secretary of Health and 3 Human Services (in this Act referred to as the ‘‘Sec- 4 retary’’) shall establish a program that provides grants to 5 States, Territories of the United States, and Indian tribes 6 for the establishment and support of pre-exposure prophy- 7 laxis (in this Act referred to as ‘‘PrEP’’) programs. 8 (b) APPLICATIONS.—To be eligible to receive a grant 9 under subsection (a), a State, Territory of the United 10 States, or Indian tribe shall submit an application to the 11 Secretary at such time, in such manner, and containing 12 such information as the Secretary may require, including 13 a description of how any funds awarded will be used. 14 (c) AMOUNT.—Any grant provided to a State, Terri- 15 tory of the United States, or Indian tribe under this sec- 16 tion may not exceed $5,000,000. 17 (d) USE OF FUNDS.—Any State, Territory of the 18 United States, or Indian tribe that is awarded funds under 19 subsection (a) shall use such funds for eligible PrEP ex- 20 penses. 21 (e) ELIGIBLE PREP EXPENSES.— 22 (1) IN GENERAL.—The Secretary shall publish 23 a list of expenses that qualify as eligible PrEP ex- 24 penses. 25 (2) INCLUSIONS.—Such list shall include— 26 VerDate Sep 11 2014 23:13 Mar 21, 2019 Jkt 089200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\H1643.IH H1643 pamtmann on DSKBFK8HB2PROD with BILLS 3 •HR 1643 IH (A) clinic and laboratory fees; 1 (B) PrEP medication; 2 (C) sexually transmitted disease testing in 3 accordance with guidelines issued by the Cen- 4 ters for Disease Control and Prevention; 5 (D) treatment adherence counseling; 6 (E) outreach activities directed toward 7 high-risk populations that increase awareness 8 about the existence of PrEP and provide edu- 9 cation about access to and health care coverage 10 of PrEP; and 11 (F) outreach activities directed toward 12 physicians that provide education about PrEP. 13 (f) MATCHING.—Any State, Territory of the United 14 States, or Indian tribe that receives a grant under sub- 15 section (a) must contribute, to the programs established 16 or supported by the grant, an amount equal to not less 17 than 20 percent of the amount of the grant. 18 (g) REPORT TO CONGRESS.—The Secretary shall, in 19 each of the first five years beginning one year after the 20 date of the enactment of this Act, submit to Congress, 21 and make public on the Internet website of the Depart- 22 ment of Health and Human Services, a report on the im- 23 pact of any grants provided to States, Territories of the 24 United States, and Indian tribes for the establishment and 25 VerDate Sep 11 2014 23:13 Mar 21, 2019 Jkt 089200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6201 E:\BILLS\H1643.IH H1643 pamtmann on DSKBFK8HB2PROD with BILLS 4 •HR 1643 IH support of pre-exposure prophylaxis programs under this 1 Act. 2 (h) AUTHORIZATION OF APPROPRIATIONS.—There 3 are authorized to be appropriated to carry out this Act 4 $50,000,000 for each of the first five fiscal years begin- 5 ning after the date of the enactment of this Act. 6 Æ VerDate Sep 11 2014 23:13 Mar 21, 2019 Jkt 089200 PO 00000 Frm 00004 Fmt 6652 Sfmt 6301 E:\BILLS\H1643.IH H1643 pamtmann on DSKBFK8HB2PROD with BILLS
