Be it enacted by the Senate and House of Representa- 1 tives of the United States of America in Congress assembled, 2 SECTION 1. SHORT TITLE. 3 This Act may be cited as the ‘‘John S. REGISTRATION REQUIREMENTS FOR PRESCRIBERS. 1 Section 303 of the Controlled Substances Act (21 2 U.S.C. 823) is amended by adding at the end the fol- 3 lowing: 4 ‘‘(l)(1) Creating obligations for practitioners, only as 5 described herein, the Attorney General shall not register, 6 or renew the registration of, a practitioner under sub- 7 section (f) who is licensed under State law to prescribe 8 controlled substances in schedule II, III, or IV, unless the 9 practitioner submits to the Attorney General, for each 10 such registration or renewal request, a certification that 11 the practitioner, during the applicable registration period, 12 will not prescribe any schedule II, III, or IV opioid, other 13 than an opioid prescription described in paragraph (3), for 14 the initial treatment of acute pain in an amount in excess 15 of the lesser of— 16 ‘‘(A) a 7-day supply (for which no refill is avail- 17 able); or 18 ‘‘(B) an opioid prescription limit established 19 under State law. 20 ‘‘(2) In this subsection, the term ‘acute pain’— 21 ‘‘(A) means pain with abrupt onset and caused 22 by an injury or other process that is not ongoing; 23 and 24 ‘‘(B) does not include— 25 ‘‘(i) chronic pain; 26 VerDate Sep 11 2014 18:09 Mar 21, 2019 Jkt 089200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\H1614.IH H1614 pamtmann on DSKBFK8HB2PROD with BILLS 3 •HR 1614 IH ‘‘(ii) pain being treated as part of cancer 1 care; 2 ‘‘(iii) hospice or other end-of-life care; or 3 ‘‘(iv) pain being treated as part of pallia- 4 tive care. 5 ‘‘(3) An opioid prescription described in this para- 6 graph is a prescription— 7 ‘‘(A) for a schedule II, III, or IV opioid drug 8 approved by the Food and Drug Administration for 9 an indication for the treatment of addiction; and 10 ‘‘(B) that is for the treatment of addiction.’’. 11 Æ VerDate Sep 11 2014 18:09 Mar 21, 2019 Jkt 089200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6301 E:\BILLS\H1614.IH H1614 pamtmann on DSKBFK8HB2PROD with BILLS
