Be it enacted by the Senate and House of Representa- 1 tives of the United States of America in Congress assembled, 2 SECTION 1. SHORT TITLE. 3 This Act may be cited as the ‘‘John S. McCain Opioid 4 Addiction Prevention Act’’. 5 SEC. 2. REGISTRATION REQUIREMENTS FOR PRESCRIBERS. 6 Section 303 of the Controlled Substances Act (21 7 U.S.C. 823) is amended by adding at the end the fol- 8 lowing: 9 VerDate Sep 11 2014 03:49 Mar 19, 2019 Jkt 089200 PO 00000 Frm 00001 Fmt 6652 Sfmt 6201 E:\BILLS\S724.IS S724 kjohnson on DSK79L0C42 with BILLS 2 •S 724 IS ‘‘(l)(1) Creating obligations for practitioners, only as 1 described herein, the Attorney General shall not register, 2 or renew the registration of, a practitioner under sub- 3 section (f) who is licensed under State law to prescribe 4 controlled substances in schedule II, III, or IV, unless the 5 practitioner submits to the Attorney General, for each 6 such registration or renewal request, a certification that 7 the practitioner, during the applicable registration period, 8 will not prescribe any schedule II, III, or IV opioid, other 9 than an opioid prescription described in paragraph (3), for 10 the initial treatment of acute pain in an amount in excess 11 of the lesser of— 12 ‘‘(A) a 7-day supply (for which no refill is avail- 13 able); or 14 ‘‘(B) an opioid prescription limit established 15 under State law. 16 ‘‘(2) In this subsection, the term ‘acute pain’— 17 ‘‘(A) means pain with abrupt onset and caused 18 by an injury or other process that is not ongoing; 19 and 20 ‘‘(B) does not include— 21 ‘‘(i) chronic pain; 22 ‘‘(ii) pain being treated as part of cancer 23 care; 24 ‘‘(iii) hospice or other end-of-life care; or 25 VerDate Sep 11 2014 03:49 Mar 19, 2019 Jkt 089200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\S724.IS S724 kjohnson on DSK79L0C42 with BILLS 3 •S 724 IS ‘‘(iv) pain being treated as part of pallia- 1 tive care. 2 ‘‘(3) An opioid prescription described in this para- 3 graph is a prescription— 4 ‘‘(A) for a schedule II, III, or IV opioid drug 5 approved by the Food and Drug Administration for 6 an indication for the treatment of addiction; and 7 ‘‘(B) that is for the treatment of addiction.’’. 8 Æ VerDate Sep 11 2014 03:49 Mar 19, 2019 Jkt 089200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6301 E:\BILLS\S724.IS S724 kjohnson on DSK79L0C42 with BILLS
