AN ACT
To amend title XVIII of the Social Security Act to provide
for transparency of Medicare secondary payer reporting
information, and for other purposes.

SECTION 1. SHORT TITLE.

This Act may be cited as the ‘‘Provide Accurate In-
2
formation Directly Act’’ or ‘‘PAID Act’’.
3
SEC. 2. TRANSPARENCY OF MEDICARE SECONDARY PAYER
4
REPORTING INFORMATION.
5
(a) IN GENERAL.—Section 1862(b)(8)(G) of the So-
6
cial Security Act (42 U.S.C. 395y(b)(8)(G)) is amended—
7
(1) by striking ‘‘INFORMATION.—The Sec-
8
retary’’ and inserting ‘‘INFORMATION.—
9
‘‘(i) IN
GENERAL.—The Secretary’’;
10
and
11
(2) by adding at the end the following new
12
clause:
13
‘‘(ii) SPECIFIED
INFORMATION.—In
14
responding to any query from an applica-
15
ble plan related to a determination de-
16
scribed in subparagraph (A)(i), the Sec-
17
retary, notwithstanding any other provision
18
of law, shall provide to such applicable
19
plan—
20
‘‘(I) whether a claimant subject
21
to the query is, or during the pre-
22
ceding 3-year period has been, entitled
23
to benefits under the program under
24
this title on any basis; and

‘‘(II) to the extent applicable, the

plan name and address of any Medi-
2
care Advantage plan under part C
3
and any prescription drug plan under
4
part D in which the claimant is en-
5
rolled or has been enrolled during
6
such period.’’.

(b) EFFECTIVE DATE.—The amendments made by
8
subsection (a) shall apply with respect to queries from
9
plans made on or after the date that is one year after
10
the date of the enactment of this Act.

SEC. 3. DEPOSIT OF SAVINGS INTO MEDICARE IMPROVE-
12
MENT FUND.

Section 1898(b)(1) of the Social Security Act (42
14
U.S.C. 1395iii(b)(1)) is amended by striking ‘‘$0’’ and in-
15
serting ‘‘$30,000,000’’.

SEC. 4. DETERMINATION OF BUDGETARY EFFECTS.
17
The budgetary effects of this Act, for the purpose of
18
complying with the Statutory Pay-As-You-Go Act of 2010,
19
shall be determined by reference to the latest statement
20
titled ‘‘Budgetary Effects of PAYGO Legislation’’ for this
21
Act, submitted for printing in the Congressional Record
22
by the Chairman of the House Budget Committee, pro-
