Mr. DOGGETT introduced the following bill; which was referred to the Com-
mittee on Energy and Commerce, and in addition to the Committee on
Ways and Means, for a period to be subsequently determined by the
Speaker, in each case for consideration of such provisions as fall within
the jurisdiction of the committee concerned
A BILL
To amend title XVIII of the Social Security Act to provide
for coverage of dental, vision, and hearing care under
the Medicare program.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.
3
This Act may be cited as the ‘‘Medicare Dental, Vi-
4
sion, and Hearing Benefit Act of 2019’’.
5
SEC. 2. DENTAL AND ORAL HEALTH CARE.
6
(a) COVERAGE.—Section 1861(s)(2) of the Social Se-
7
curity Act (42 U.S.C. 1395x(s)(2)) is amended—

(b) DENTAL
AND ORAL HEALTH SERVICES DE-
9
FINED.—Section 1861 of the Social Security Act (42
10
U.S.C. 1395x) is amended by adding at the end the fol-
11
lowing new subsection:

‘‘Dental and Oral Health Services
13
‘‘(kkk) The term ‘dental and oral health services’
14
means—
15
‘‘(1) routine dental cleanings and exams;
16
‘‘(2) basic dental services, such as fillings and
17
crowns;
18
‘‘(3) major dental services, such as root canals,
19
and extractions;
20
‘‘(4) emergency dental care; and
21
‘‘(5) other necessary services related to dental
22
or oral health (as defined by the Secretary).’’.

(c) PAYMENT; COINSURANCE; AND LIMITATIONS.—

(1) IN GENERAL.—Section 1833(a)(1) of the

Social Security Act (42 U.S.C. 1395l(a)(1)) is
2
amended—
3
(A) by striking ‘‘and’’ before ‘‘(CC)’’; and
4
(B) by inserting before the semicolon at
5
the end the following: ‘‘, and (DD) with respect
6
to dental and oral health services (as defined in
7
section 1861(jjj)), the amount paid shall be the
8
payment
amount
specified
under
section
9
1834(v)’’.

(2) PAYMENT AND LIMITS SPECIFIED.—Section
11
1834 of the Social Security Act (42 U.S.C. 1395m)
12
is amended by adding at the end the following new
13
subsection:

‘‘(x) PAYMENT AND LIMITS FOR DENTAL AND ORAL
15
HEALTH SERVICES.—
16
‘‘(1) IN
GENERAL.—The payment amount
17
under this part for dental and oral health services
18
(as defined in section 1861(kkk)) shall be, subject to
19
paragraph (3), the applicable percent (specified in
20
paragraph (2)) of the lesser of the actual charge for
21
the services or the amount determined under the
22
payment basis determined under section 1848.

‘‘(2) APPLICABLE PERCENT.—For purposes of

paragraph (1), the applicable percent specified in
2
this paragraph is—
3
‘‘(A) for the first year beginning at least 6
4
months after the date of the enactment of this
5
subsection, 0 percent;
6
‘‘(B) for the year following the year speci-
7
fied in subparagraph (A) and each subsequent
8
year through the seventh year following the
9
year specified in subparagraph (A), the applica-
10
ble percent specified in this paragraph for the
11
previous year increased by 10 percentage
12
points; and
13
‘‘(C) for the eighth year following the year
14
specified in subparagraph (A) and each subse-
15
quent year, 80 percent.
16
‘‘(3) LIMITATIONS AND SECRETARIAL AUTHOR-
17
ITY.—
18
‘‘(A) FREQUENCY.—With respect to dental
19
and oral health services that are—
20
‘‘(i) routine dental cleanings, payment
21
may be made under this part for only two
22
such cleanings during a 12-month period;
23
and

‘‘(B) SECRETARIAL AUTHORITY.—

‘‘(i) AUTHORITY

apply such other reasonable limitations on
7
the extent to which dental and oral services
8
are covered under this part, including
9
through application of a prior authoriza-
10
tion requirement.

‘‘(ii) AUTHORITY
TO
MODIFY
COV-
12
ERAGE.—Notwithstanding any other provi-
13
sion of this title, if the Secretary deter-
14
mines appropriate, the Secretary may mod-
15
ify the coverage under this part of dental
16
and oral health services to the extent that
17
such modification is consistent with the
18
recommendations of the United States Pre-
19
ventive Services Task Force.’’.
20
(d) PAYMENT UNDER PHYSICIAN FEE SCHEDULE.—
21
Section 1848(j)(3) of the Social Security Act (42 U.S.C.
22
1395w–4(j)(3)) is amended by inserting ‘‘(2)(II),’’ before
23
‘‘(3)’’.

PAYMENT
RULES.—Section

1834(a) of the Social Security Act (42 U.S.C.
8
1395m(a)) is amended by adding at the end the fol-
9
lowing new paragraph:

‘‘(23) PAYMENT AND LIMITS FOR DENTURES.—
11
‘‘(A) IN GENERAL.—The payment amount
12
under this part for dentures shall be, subject to
13
subparagraph (C), the applicable percent (speci-
14
fied in subparagraph (B)) of the amount other-
15
wise payable for such dentures under this sec-
16
tion.

‘‘(B) APPLICABLE
PERCENT.—For pur-
18
poses of subparagraph (A), the applicable per-
19
cent specified in this subparagraph is—
20
‘‘(i) for the first year beginning at
21
least 6 months after the date of the enact-
22
ment of this paragraph, 0 percent;
23
‘‘(ii) for the year following the year

specified in clause (i) and each subsequent

year through the seventh year following the

percent specified in this subparagraph for

the previous year increased by 10 percent-
4
age points; and
5
‘‘(iii) for the eighth year following the
6
year specified in clause (i) and each subse-
7
quent year, 80 percent.

‘‘(C) LIMITATIONS AND SECRETARIAL AU-
9
THORITY.—
10
‘‘(i) IN GENERAL.—Payment may be
11
made under this part for an individual
12
for—
13
‘‘(I) not more than one full upper
14
and one full lower denture once every
15
five years; and
16
‘‘(II) not more than one partial
17
upper denture and one partial lower
18
denture once every five years.
19
‘‘(ii) SECRETARIAL AUTHORITY.—
20
‘‘(I) AUTHORITY TO APPLY ADDI-
21
TIONAL LIMITATIONS.—The Secretary
22
may apply such other reasonable limi-
23
tations on the extent to which den-
24
tures are covered under this part, in-

‘‘(II) AUTHORITY
TO
MODIFY

COVERAGE.—Notwithstanding
any
4
other provision of this title, if the Sec-
5
retary determines appropriate, the
6
Secretary may modify the coverage
7
under this part of dentures to the ex-
8
tent that such modification is con-
9
sistent with the recommendations of
10
the United States Preventive Services
11
Task Force.’’.
12
(f) REPEAL OF GROUND FOR EXCLUSION.—Section
13
1862(a) of the Social Security Act (42 U.S.C. 1395y) is
14
amended by striking paragraph (12).
15
(g) EFFECTIVE DATE.—The amendments made by
16
this section shall apply to services furnished on or after
17
January 1 of the first year beginning at least six months
18
after the date of the enactment of this Act.

SEC. 3. VISION CARE.
20
(a) COVERAGE.—Section 1861(s)(2) of the Social Se-
21
curity Act (42 U.S.C. 1395x(s)(2)), as amended by section
22
2, is further amended—
23
(1) in subparagraph (HH), by striking ‘‘and’’
24
after the semicolon at the end;

(b) VISION SERVICES DEFINED.—Section 1861 of
7
the Social Security Act (42 U.S.C. 1395x), as amended
8
by section 2, is further amended by adding at the end the
9
following new subsection:
10
‘‘Vision Services
11
‘‘(lll) The term ‘vision services’ means—
12
‘‘(1) routine eye examinations and procedures
13
performed (during the course of any eye examina-
14
tion) to determine the refractive state of the eyes;
15
and
16
‘‘(2) other necessary services related to eye and
17
vision health (as defined by the Secretary).’’.
18
(c) PAYMENT; COINSURANCE; AND LIMITATIONS.—
19
(1) IN GENERAL.—Section 1833(a)(1) of the
20
Social Security Act (42 U.S.C. 1395l(a)(1)), as
21
amended by section 2, is further amended—
22
(A) by striking ‘‘and’’ before ‘‘(DD)’’; and
23
(B) by inserting before the semicolon at
24
the end the following: ‘‘, and (EE) with respect
