A BILL
To amend title II of the Social Security Act to eliminate
the five-month waiting period for disability insurance
benefits for individuals with amyotrophic lateral sclerosis
(ALS).
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

This Act may be cited as the ‘‘ALS Disability Insur-
4
ance Access Act of 2019’’.

SEC. 2. ELIMINATION OF WAITING PERIOD FOR INDIVID-
6
UALS WITH AMYOTROPHIC LATERAL SCLE-
7
ROSIS (ALS).

(a) IN GENERAL.—Section 223 of the Social Security
9
Act (42 U.S.C. 423) is amended—
10
(1) in subsection (a)—
11
(A) in paragraph (1), in the matter fol-
12
lowing subparagraph (E), by striking ‘‘or (ii)’’
13
and inserting ‘‘(ii) in the case of an individual
14
who has been medically determined to have
15
amyotrophic lateral sclerosis (ALS), for each
16
month beginning with the first month during all
17
of which the individual is under a disability and
18
in which the individual becomes entitled to such
19
insurance benefits, or (iii)’’; and

(b) EFFECTIVE DATE.—The amendments made by
3
this section shall apply with respect to applications for dis-
4
ability insurance benefits filed after the date of the enact-
5
ment of this Act.
