mental health services for students, and for other purposes.

Mr. DAVID P. ROE of Tennessee (for himself and Mr. BLUMENAUER) intro-
duced the following bill; which was referred to the Committee on Edu-
cation and Labor
A BILL
To amend the Elementary and Secondary Education Act
of 1965 to improve mental health services for students,
and for other purposes.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.
3
This Act may be cited as the ‘‘Youth Mental Health
4
Services Act of 2019’’.
5
SEC. 2. SUPPORTING MENTAL HEALTH.
6
(a) STATE USE OF FUNDS.—Section 4104(b)(3)(B)
7
of the Elementary and Secondary Education Act of 1965
8
(20 U.S.C. 7114(b)(3)(B)) is amended—

(1) in clause (iii), by striking ‘‘and’’ at the end;

and
2
(2) by adding at the end the following:

‘‘(v) improving the mental health serv-
4
ices available to students, which may in-
5
clude—
6
‘‘(I) identifying and dissemi-
7
nating best practices for mental
8
health first aid;
9
‘‘(II) assisting in the establish-
10
ment or implementation of emergency
11
planning, which may include emer-
12
gency response teams to address
13
emergencies at schools;
14
‘‘(III) establishing or identifying
15
agreements with local health agencies,
16
including nonprofit, public, and pri-
17
vate mental health agencies and insti-
18
tutions, to improve coordination of
19
services; and
20
‘‘(IV) telehealth services; and’’.

(b) LOCAL EDUCATIONAL AGENCY APPLICATIONS.—
22
Section 4106(e)(1) of the Elementary and Secondary Edu-
23
cation Act of 1965 (20 U.S.C. 7116(e)(1)) is amended—

(1) in subparagraph (D), by striking ‘‘and’’ at

the end;

(2) by redesignating subparagraph (E) as sub-

paragraph (F); and
4
(3) by inserting after subparagraph (D), the
5
following:

‘‘(E) if applicable, how funds will be used
7
for activities related to providing mental health
8
services under section 4108; and’’.

(c) ACTIVITIES TO SUPPORT THE EFFECTIVE USE
10
OF TECHNOLOGY.—Section 4109 of the Elementary and
11
Secondary Education Act of 1965 (20 U.S.C. 7119) is
12
amended—
13
(1) in subsection (a)—
14
(A) in paragraph (5), by striking ‘‘and’’ at
15
the end;
16
(B) in paragraph (6), by striking the pe-
17
riod at the end and inserting ‘‘; and’’; and
18
(C) by adding at the end the following:
19
‘‘(7) providing technology to improve mental
20
health services.’’; and
21
(2) in subsection (b)—
22
(A) by striking ‘‘A local’’ and inserting the
23
following:
24
‘‘(1) IN GENERAL.—A local’’; and

‘‘(2) EXCEPTION.—The limitation described in

paragraph (1) shall not apply to technology infra-
3
structure that is also used for mental health serv-
4
ices.’’.
