To amend title XIX of the Social Security Act to provide the same level
of Federal matching assistance for every State that chooses to expand
Medicaid coverage to newly eligible individuals, regardless of when such
expansion takes place.

duced the following bill; which was read twice and referred to the Com-
mittee on Finance
A BILL
To amend title XIX of the Social Security Act to provide
the same level of Federal matching assistance for every
State that chooses to expand Medicaid coverage to newly
eligible individuals, regardless of when such expansion
takes place.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

This Act may be cited as the ‘‘States Achieve Med-
4
icaid Expansion Act of 2019’’ or the ‘‘SAME Act of
5
2019’’.

SEC. 2. INCREASED FMAP FOR MEDICAL ASSISTANCE TO

NEWLY ELIGIBLE INDIVIDUALS.

(a) IN GENERAL.—Section 1905 of the Social Secu-
3
rity Act (42 U.S.C. 1396d) is amended—
4
(1) in subsection (y)(1)—
5
(A) in subparagraph (A), by striking
6
‘‘2014, 2015, and 2016’’ and inserting ‘‘each of
7
the first 3 consecutive 12-month periods in
8
which the State provides medical assistance to
9
newly eligible individuals’’;
10
(B) in subparagraph (B), by striking
11
‘‘2017’’ and inserting ‘‘the fourth consecutive
12
12-month period in which the State provides
13
medical assistance to newly eligible individuals’’;
14
(C) in subparagraph (C), by striking
15
‘‘2018’’ and inserting ‘‘the fifth consecutive 12-
16
month period in which the State provides med-
17
ical assistance to newly eligible individuals’’;
18
(D) in subparagraph (D), by striking
19
‘‘2019’’ and inserting ‘‘the sixth consecutive 12-
20
month period in which the State provides med-
21
ical assistance to newly eligible individuals’’;
22
and
23
(E) in subparagraph (E), by striking
24
‘‘2020 and each year thereafter’’ and inserting
25
‘‘the seventh consecutive 12-month period in

which the State provides medical assistance to

newly eligible individuals and each such period
2
thereafter’’; and
3
(2) in subsection (z)(2)(B)(i)(II), by inserting
4
‘‘(as in effect on the day before the enactment of the
5
States Achieve Medicaid Expansion Act of 2019)’’
6
after ‘‘subsection (y)(1)’’.

(b) RETROACTIVE APPLICATION.—The amendments
8
made by subsection (a)(1) shall take effect as if included
9
in the enactment of Public Law 111–148 and shall apply
10
to amounts expended by any State for medical assistance
11
for newly eligible individuals described in subclause (VIII)
12
of section 1902(a)(10)(A)(i) of the Social Security Act
13
under a State Medicaid plan (or a waiver of such plan)
14
during the period before the date of enactment of this Act.
