A BILL
To require the national instant criminal background check
system to notify U.S. Immigration and Customs Enforce-
ment of firearm transfer denials by reason of illegal
or unlawful presence in the United States.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

This Act may be cited as the ‘‘Notify ICE Act’’.

SEC. 2. NOTIFICATION TO U.S. IMMIGRATION AND CUS-

TOMS ENFORCEMENT OF FIREARM TRANS-

FER DENIALS BY REASON OF ILLEGAL OR UN-
3
LAWFUL PRESENCE IN THE UNITED STATES.

From time to time, the Attorney General shall trans-
5
mit to U.S. Immigration and Customs Enforcement of the
6
Department of Homeland Security a report which identi-
7
fies each individual with respect to whom, during the pe-
8
riod covered by the report, the national instant criminal
9
background check system established under section 103
10
of the Brady Handgun Violence Prevention Act has—
11
(1) notified a person licensed under chapter 44
12
of title 18, United States Code, that the individual
13
is ineligible to receive a firearm; and
14
(2) provided the notice because the information
15
available to the system indicates that the individual
16
is illegally or unlawfully in the United States.
