SHORT TITLE. 3 This title may be cited as the ‘‘Federal Firearms Li- 4 censee Protection Act of 2019’’. 5 SEC. 102. AMENDMENTS TO ENHANCE CERTAIN PENALTIES. 6 Section 924 of title 18, United States Code, is 7 amended— 8 (1) by striking subsection (i) and inserting the 9 following: 10 ‘‘(i)(1)(A) A person who knowingly violates section 11 922(u), or attempts to do so, shall be fined under this 12 title, imprisoned not more than 20 years, or both. 13 ‘‘(B) In the case of a violation described in subpara- 14 graph (A) that occurs during the commission of— 15 ‘‘(i) a burglary, the term of imprisonment shall 16 be not less than 3 years; or 17 ‘‘(ii) a robbery, the term of imprisonment shall 18 be not less than 5 years. 19 ‘‘(2) In this subsection— 20 ‘‘(A) the term ‘burglary’ means the unlawful 21 entry into, or remaining in, the business premises of 22 a licensed importer, licensed manufacturer, or li- 23 censed dealer with the intent to commit a crime; and 24 VerDate Sep 11 2014 02:26 Mar 02, 2019 Jkt 089200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\H1339.IH H1339 kjohnson on DSK79L0C42 with BILLS 3 •HR 1339 IH ‘‘(B) the term ‘robbery’ has the meaning given 1 the term in section 1951(b).’’; and 2 (2) in subsection (m), by inserting ‘‘or attempts 3 to do so,’’ after ‘‘or licensed collector’’. 4 SEC. 103. CRIME OF VIOLENCE. 5 (a) AMENDMENT TO THE DEFINITION OF CRIME OF 6 VIOLENCE.—Section 924(c)(3)(B) of title 18, United 7 States Code, is amended— 8 (1) by striking ‘‘by its nature, involves’’ and in- 9 serting ‘‘, based on the facts underlying the offense, 10 involved’’; and 11 (2) by striking ‘‘may be used’’ and inserting 12 ‘‘may have been used’’. 13 (b) APPLICATION.— 14 (1) IN GENERAL.—The amendments made by 15 this section shall apply to any offense committed on 16 or after the date of the enactment of this Act. 17 (2) RULE OF CONSTRUCTION.—The amend- 18 ments made by this section shall not be construed to 19 create any right to challenge a sentence imposed be- 20 fore the date of the enactment of this Act under sec- 21 tion 924 of title 18, United States Code. 22 VerDate Sep 11 2014 02:26 Mar 02, 2019 Jkt 089200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6201 E:\BILLS\H1339.IH H1339 kjohnson on DSK79L0C42 with BILLS 4 •HR 1339 IH TITLE II—MASS VIOLENCE 1 PREVENTION CENTER 2 SEC. 201. MASS VIOLENCE PREVENTION CENTER. 3 Part G of the Omnibus Crime Control and Safe 4 Streets Act of 1968 (34 U.S.C. 10211 et seq.) is amended 5 by adding at the end the following: 6 ‘‘SEC. 702. MASS VIOLENCE PREVENTION CENTER. 7 ‘‘(a) ESTABLISHMENT.—There is established in the 8 Department of Justice a Mass Violence Prevention Center, 9 which shall be supervised by the Director of Mass Violence 10 Prevention (in this section referred to as the ‘Director’), 11 who shall be appointed by the Director of the Federal Bu- 12 reau of Investigation with the approval of the President. 13 ‘‘(b) AUTHORITY OF FBI DIRECTOR.—The Director 14 of the Federal Bureau of Investigation shall have author- 15 ity, direction, and control over the Mass Violence Preven- 16 tion Center and the Director of Mass Violence Prevention. 17 ‘‘(c) REPORTING.—Not later than 1 year after the 18 date of the enactment of this section, and annually there- 19 after, the Director shall submit a report to the Attorney 20 General with respect to the following matters: 21 ‘‘(1) The budget and programs of the Mass Vio- 22 lence Prevention Center. 23 ‘‘(2) The activities of the Director under sub- 24 section (f). 25 VerDate Sep 11 2014 02:26 Mar 02, 2019 Jkt 089200 PO 00000 Frm 00004 Fmt 6652 Sfmt 6201 E:\BILLS\H1339.IH H1339 kjohnson on DSK79L0C42 with BILLS 5 •HR 1339 IH ‘‘(3) The conduct of intelligence operations im- 1 plemented by other elements of the intelligence com- 2 munity. 3 ‘‘(d) PURPOSE.—The purpose of the Mass Violence 4 Prevention Center shall be as follows: 5 ‘‘(1) To serve as the primary organization in 6 the United States Government for analyzing and in- 7 tegrating all intelligence possessed or acquired by 8 the United States Government pertaining to threats 9 of mass violence. 10 ‘‘(2) To conduct strategic operational planning 11 for mass violence prevention, integrating all instru- 12 ments of Federal, State, and local law enforcement. 13 ‘‘(3) To recommend roles and responsibilities to 14 Federal, State, and local law enforcement partners 15 as part of its strategic operational planning duties to 16 lead departments or agencies, as appropriate, for 17 mass violence prevention that are consistent with ap- 18 plicable law and that support strategic operational 19 plans for mass violence prevention. 20 ‘‘(4) To ensure that Federal, State, and local 21 law enforcement agencies, have access to and receive 22 all-source intelligence support needed to execute 23 plans to prevent mass violence or perform inde- 24 VerDate Sep 11 2014 02:26 Mar 02, 2019 Jkt 089200 PO 00000 Frm 00005 Fmt 6652 Sfmt 6201 E:\BILLS\H1339.IH H1339 kjohnson on DSK79L0C42 with BILLS 6 •HR 1339 IH pendent, alternative analysis on threats of mass vio- 1 lence, or for other purposes, as appropriate. 2 ‘‘(5) To serve as the central and shared knowl- 3 edge bank on known and suspected perpetrators of 4 mass violence, as well as the perpetrator’s goals, 5 strategies, capabilities, and networks of contacts and 6 support. 7 ‘‘(e) DUTIES AND RESPONSIBILITIES OF DIREC- 8 TOR.—The Director shall— 9 ‘‘(1) provide strategic operational plans for 10 mass violence prevention efforts of the United States 11 Government and for the effective integration of mass 12 violence intelligence and operations across agency 13 boundaries; 14 ‘‘(2) advise the Attorney General on the extent 15 to which the mass violence prevention program rec- 16 ommendations and budget proposals of the depart- 17 ments, agencies, and elements of the United States 18 Government conform to the priorities established by 19 the President. 20 ‘‘(3) disseminate mass violence threat informa- 21 tion, including a current mass violence threat anal- 22 ysis, to the President, the Vice President, the Attor- 23 ney General, the Secretary of Homeland Security, 24 and other officials of the executive branch as appro- 25 VerDate Sep 11 2014 02:26 Mar 02, 2019 Jkt 089200 PO 00000 Frm 00006 Fmt 6652 Sfmt 6201 E:\BILLS\H1339.IH H1339 kjohnson on DSK79L0C42 with BILLS 7 •HR 1339 IH priate, and to the appropriate committees of Con- 1 gress; 2 ‘‘(4) support the Department of Justice, and 3 other appropriate agencies, in fulfillment of their re- 4 sponsibilities to disseminate mass violence threat in- 5 formation, consistent with applicable law, Executive 6 orders, and other Presidential guidance to State and 7 local government officials, and other entities, and co- 8 ordinate dissemination of mass violence threat infor- 9 mation to State and local law enforcement agencies 10 as approved by the Attorney General; 11 ‘‘(5) consistent with priorities approved by the 12 President, establish requirements for the intelligence 13 community for the collection of mass violence threat 14 information; and 15 ‘‘(6) perform such other duties as the Attorney 16 General may prescribe or are prescribed by law. 17 ‘‘(f) RESOLUTION OF DISPUTES.—The Attorney Gen- 18 eral shall resolve disagreements between the Mass Violence 19 Prevention Center and the head of a department, agency, 20 or element of the United States Government on designa- 21 tions, assignments, plans, or responsibilities under this 22 section. ADDITIONAL ASSISTANT UNITED STATES ATTOR- 5 NEYS. 6 There are authorized to be appropriated for each of 7 fiscal years 2020, 2021, 2022, 2023, and 2024, 8 $10,000,000 for the appointment of not fewer than 50 as- 9 sistant United States attorneys in such districts as the 10 Attorney General determines appropriate, based on the in- 11 cidence of firearms-related violence.
