Be it enacted by the Senate and House of Representa- 1 tives of the United States of America in Congress assembled, 2 SECTION 1. INCREASE IN AGE AT WHICH A RIFLE OR SHOTGUN 1 MAY BE ACQUIRED FROM A FEDERALLY LI- 2 CENSED FIREARMS DEALER. 3 (a) IN GENERAL.—Section 922(b) of title 18, United 4 States Code, is amended— 5 (1) by striking paragraph (1) and inserting the 6 following: 7 ‘‘(1) any firearm or ammunition to any indi- 8 vidual who the licensee knows or has reasonable 9 cause to believe has not attained 21 years of age, 10 unless the individual is— 11 ‘‘(A) a law enforcement officer; 12 ‘‘(B) a correctional officer; 13 ‘‘(C) on active duty in the Armed Forces 14 of the United States, or full-time duty in the 15 National Guard; or 16 ‘‘(D) a member of the Armed Forces of the 17 United States or the National Guard who pos- 18 sesses or is armed with a firearm in the line of 19 duty;’’. 20 (b) CONFORMING AMENDMENT.—Section 922(c)(1) 21 of such title is amended by striking ‘‘, or that, in the case 22 of a shotgun or a rifle, I am eighteen years or more of 23 age’’ and inserting ‘‘or am a law enforcement officer, a 24 correctional officer, on active duty in the Armed Forces 25 of the United States or full-time duty in the National 26 VerDate Sep 11 2014 03:03 Feb 28, 2019 Jkt 089200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\H1262.IH H1262 kjohnson on DSK79L0C42 with BILLS 3 •HR 1262 IH Guard, or a member of the Armed Forces of the United 1 States or the National Guard who possesses or is armed 2 with a firearm in the line of duty’’. 3 (c) DEFINITIONS.—Section 921(a) of such title is 4 amended by inserting after paragraph (29) the following: 5 ‘‘(30) The term ‘law enforcement officer’ means a 6 person— 7 ‘‘(A) who is elected, appointed, or employed by 8 the Federal Government or by a State or political 9 subdivision thereof; 10 ‘‘(B) who is vested with authority to bear arms 11 and make arrests; and 12 ‘‘(C) whose primary responsibility is the preven- 13 tion and detection of crime or the enforcement of the 14 penal, criminal, traffic, or highway laws, 15 including any supervisory or command personnel whose 16 duties include the supervision, training, guidance, or man- 17 agement of any such person. 18 ‘‘(31) The term ‘correctional officer’ means a per- 19 son— 20 ‘‘(A) who is appointed or employed by the Fed- 21 eral Government or by a State or political subdivi- 22 sion thereof, and whose primary responsibility is the 23 supervision, protection, care, custody, and control, or 24 VerDate Sep 11 2014 03:03 Feb 28, 2019 Jkt 089200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6201 E:\BILLS\H1262.IH H1262 kjohnson on DSK79L0C42 with BILLS 4 •HR 1262 IH investigation, of inmates of a correctional institution; 1 or 2 ‘‘(B) who is employed by any private entity that 3 has contracted with the Federal Government or a 4 State or political subdivision thereof, and who has 5 such a primary responsibility.’’. 6 (d) EFFECTIVE DATE.—The amendments made by 7 this section shall apply to conduct engaged in after the 8 6-month period that begins with the date of enactment 9 of this Act. 10 Æ VerDate Sep 11 2014 03:03 Feb 28, 2019 Jkt 089200 PO 00000 Frm 00004 Fmt 6652 Sfmt 6301 E:\BILLS\H1262.IH H1262 kjohnson on DSK79L0C42 with BILLS
