To establish a tiered hiring preference for members of the
reserve components of the Armed Forces.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.
3
This Act may be cited as the ‘‘Military Reserve Jobs
4
Act of 2019’’.

FORCES.

(a) PREFERENCE ELIGIBILITY FOR MEMBERS OF
4
RESERVE COMPONENTS OF THE ARMED FORCES.—Sec-
5
tion 2108 of title 5, United States Code, is amended—
6
(1) in paragraph (3)—
7
(A) in subparagraph (G)(ii), by striking
8
‘‘and’’ at the end;
9
(B) in subparagraph (H), by adding ‘‘and’’
10
at the end; and
11
(C) by inserting after subparagraph (H)
12
the following:
13
‘‘(I) a qualified reservist;’’;
14
(2) in paragraph (4), by striking ‘‘and’’ at the
15
end;
16
(3) in paragraph (5), by striking the period at
17
the end and inserting a semicolon; and
18
(4) by adding at the end the following:
19
‘‘(6) ‘qualified reservist’ means an individual
20
who is a member of a reserve component of the
21
Armed Forces on the date of the applicable deter-
22
mination—

‘‘(A) who—

‘‘(i) has completed at least 6 years of

service in a reserve component of the
2
Armed Forces; and
3
‘‘(ii) in each year of service in a re-
4
serve component of the Armed Forces, was
5
credited with at least 50 points under sec-
6
tion 12732 of title 10; or
7
‘‘(B) who—
8
‘‘(i) has completed at least 10 years of
9
service in a reserve component of the
10
Armed Forces; and
11
‘‘(ii) in each year of service in a re-
12
serve component of the Armed Forces, was
13
credited with at least 50 points under sec-
14
tion 12732 of title 10; and
15
‘‘(7) ‘reserve component of the Armed Forces’
16
means a reserve component specified in section
17
101(27) of title 38.’’.

(b) TIERED HIRING PREFERENCE FOR MEMBERS OF
19
RESERVE COMPONENTS OF THE ARMED FORCES.—Sec-
20
tion 3309 of title 5, United States Code, is amended—
21
(1) in paragraph (1), by striking ‘‘and’’ at the
22
end;
23
(2) in paragraph (2), by striking the period at
24
the end and inserting a semicolon; and

(3) by adding at the end the following:

‘‘(3) a preference eligible described in section
2
2108(6)(B)—3 points; and
3
‘‘(4) a preference eligible described in section
4
2108(6)(A)—2 points.’’.

(c) GAO REVIEW.—Not later than 3 years after the
6
date of enactment of this Act, the Comptroller General
7
of the United States shall submit to Congress a report
8
that—
9
(1) assesses Federal employment opportunities
10
for members of a reserve component of the Armed
11
Forces;
12
(2) evaluates the impact of the amendments
13
made by this section on the hiring of reservists and
14
veterans by the Federal Government; and
15
(3) provides recommendations, if any, for
16
strengthening Federal employment opportunities for
17
members of a reserve component of the Armed
18
Forces.
