SHORT TITLE. 3 This Act may be cited as the ‘‘Aviation Funding Sta- 4 bility Act of 2019’’. 5 SEC. 2. FUNDING FOR THE FEDERAL AVIATION ADMINIS- 6 TRATION IN THE EVENT OF A LAPSE IN AP- 7 PROPRIATION. 8 (a) IN GENERAL.—If, with respect to the Federal Avia- 9 tion Administration, an appropriation measure for a fiscal 10 year is not enacted before the beginning of such fiscal year 11 or a joint resolution making continuing appropriations is 12 not in effect, amounts in the Airport and Airway Trust 13 Fund not otherwise appropriated shall be available to the 14 Administrator for continuing programs, projects, or activi- 15 ties (including the costs of direct loans and loan guarantees) 16 that were conducted with amounts made available for the 17 Federal Aviation Administration, including for the ac- 18 counts ‘‘Federal Aviation Administration—Operations’’, 19 ‘‘Federal Aviation Administration—Facilities and Equip- 20 ment’’, ‘‘Federal Aviation Administration—Research, En- 21 gineering, and Development’’, and ‘‘Federal Aviation Ad- 22 ministration—Grants-in-Aid for Airports’’ in the pre- 23 ceding fiscal year— 24 VerDate Sep 11 2014 22:24 Dec 22, 2020 Jkt 019200 PO 00000 Frm 00005 Fmt 6652 Sfmt 6203 E:\BILLS\H1108.RH H1108 kjohnson on DSK79L0C42PROD with BILLS 6 •HR 1108 RH (1) in the corresponding appropriation Act for 1 such preceding fiscal year; or 2 (2) if the corresponding appropriation bill for 3 such preceding fiscal year did not become law, then 4 in a joint resolution making continuing appropria- 5 tions for such preceding fiscal year. 6 (b) RATE FOR OPERATIONS.—Appropriations and 7 funds made available, and authority granted, for a pro- 8 gram, project, or activity for any fiscal year pursuant to 9 this section shall be at a rate for operations not greater than 10 — 11 (1) the rate for operations provided for in the 12 regular appropriation Act providing for such pro- 13 gram, project, or activity for the preceding fiscal 14 year; or 15 (2) in the absence of such an Act, the rate for op- 16 erations provided for such program, project, or activ- 17 ity pursuant to a joint resolution making continuing 18 appropriations for such preceding fiscal year. 19 (c) AVAILABILITY.—Appropriations and funds made 20 available, and authority granted, for any fiscal year pursu- 21 ant to this section for a program, project, or activity shall 22 be available for the period beginning with the first day of 23 a lapse in appropriations and ending with the date on 24 which the applicable regular appropriation bill for such fis- 25 VerDate Sep 11 2014 22:24 Dec 22, 2020 Jkt 019200 PO 00000 Frm 00006 Fmt 6652 Sfmt 6203 E:\BILLS\H1108.RH H1108 kjohnson on DSK79L0C42PROD with BILLS 7 •HR 1108 RH cal year becomes law (whether or not such law provides for 1 such program, project, or activity) or a joint resolution 2 making continuing appropriations becomes law, as the case 3 may be. 4 (d) TERMS AND CONDITIONS.—An appropriation or 5 funds made available, or authority granted, for a program, 6 project, or activity for any fiscal year pursuant to this sec- 7 tion shall be subject to the terms and conditions imposed 8 with respect to the appropriation made or funds made 9 available for the preceding fiscal year, or authority granted 10 for such program, project, or activity under current law. 11 (e) END OF FISCAL YEAR.—If this section is in effect 12 at the end of a fiscal year, funding levels shall continue 13 as provided in this section for the next fiscal year. 14 (f) EXPENDITURES AND OBLIGATIONS.—Expenditures 15 and obligations made for a program, project, or activity 16 for any fiscal year pursuant to this section shall be charged 17 to the applicable appropriation, fund, or authorization 18 whenever a regular appropriation bill or a joint resolution 19 making continuing appropriations until the end of a fiscal 20 year providing for such program, project, or activity for 21 such period becomes law. 22 (g) EXPENDITURE AUTHORITY.—Section 23 9502(d)(1)(A) of the Internal Revenue Code of 1986 is 24 VerDate Sep 11 2014 22:24 Dec 22, 2020 Jkt 019200 PO 00000 Frm 00007 Fmt 6652 Sfmt 6203 E:\BILLS\H1108.RH H1108 kjohnson on DSK79L0C42PROD with BILLS 8 •HR 1108 RH amended by striking the semicolon at the end and inserting 1 ‘‘or the Aviation Funding Stability Act of 2019;’’. 2 (h) TERMINATION.—This section shall not apply to a 3 program, project, or activity during any portion of a fiscal 4 year if any other provision of law (other than an authoriza- 5 tion of appropriations)— 6 (1) makes an appropriation, makes funds avail- 7 able, or grants authority for such program, project, or 8 activity to continue for such period; or 9 (2) specifically provides that no appropriation 10 shall be made, no funds shall be made available, or 11 no authority shall be granted for such program, 12 project, or activity to continue for such period. 13 SEC. 3.
