R. 1146 AN ACT To amend Public Law 115–97 (commonly known as the Tax Cuts and Jobs Act) to repeal the Arctic National Wildlife Refuge oil and gas program, and for other pur- poses. Be it enacted by the Senate and House of Representa- 1 tives of the United States of America in Congress assembled, 2 2 •HR 1146 EH SECTION 1. SHORT TITLE. 1 This Act may be cited as the ‘‘Arctic Cultural and 2 Coastal Plain Protection Act’’. 3 SEC. 2. REPEAL OF ARCTIC NATIONAL WILDLIFE REFUGE 4 OIL AND GAS PROGRAM. 5 Section 20001 of Public Law 115–97 (16 U.S.C. 6 3143 note) is hereby repealed. 7 SEC. 3. INSPECTION FEE COLLECTION. 8 Section 22 of the Outer Continental Shelf Lands Act 9 (43 U.S.C. 1348) is amended by adding at the end the 10 following: 11 ‘‘(g) INSPECTION FEES.— 12 ‘‘(1) ESTABLISHMENT.—The Secretary of the 13 Interior shall collect from the operators of facilities 14 subject to inspection under subsection (c) non-re- 15 fundable fees for such inspections— 16 ‘‘(A) at an aggregate level equal to the 17 amount necessary to offset the annual expenses 18 of inspections of outer Continental Shelf facili- 19 ties (including mobile offshore drilling units) by 20 the Secretary of the Interior; and 21 ‘‘(B) using a schedule that reflects the dif- 22 ferences in complexity among the classes of fa- 23 cilities to be inspected. 24 ‘‘(2) OCEAN ENERGY SAFETY FUND.—There is 25 established in the Treasury a fund, to be known as 26 3 •HR 1146 EH the ‘Ocean Energy Safety Fund’ (referred to in this 1 subsection as the ‘Fund’), into which shall be depos- 2 ited all amounts collected as fees under paragraph 3 (1) and which shall be available as provided under 4 paragraph (3). 5 ‘‘(3) AVAILABILITY OF FEES.—Notwithstanding 6 section 3302 of title 31, United States Code, all 7 amounts deposited in the Fund— 8 ‘‘(A) shall be credited as offsetting collec- 9 tions; 10 ‘‘(B) shall be available for expenditure for 11 purposes of carrying out inspections of outer 12 Continental Shelf facilities (including mobile 13 offshore drilling units) and the administration 14 of the inspection program under this section; 15 ‘‘(C) shall be available only to the extent 16 provided for in advance in an appropriations 17 Act; and 18 ‘‘(D) shall remain available until expended. 19 ‘‘(4) ADJUSTMENT FOR INFLATION.—For each 20 fiscal year beginning after fiscal year 2020, the Sec- 21 retary shall adjust each dollar amount specified in 22 this subsection for inflation based on the change in 23 the Consumer Price Index from fiscal year 2020. 24 4 •HR 1146 EH ‘‘(5) ANNUAL FEES.—Annual fees shall be col- 1 lected under this subsection for facilities that are 2 above the waterline, excluding drilling rigs, and are 3 in place at the start of the fiscal year. Fees for fiscal 4 year 2020 shall be— 5 ‘‘(A) $25,300 for facilities with no wells, 6 but with processing equipment or gathering 7 lines; 8 ‘‘(B) $40,700 for facilities with 1 to 10 9 wells, with any combination of active or inactive 10 wells; and 11 ‘‘(C) $75,900 for facilities with more than 12 10 wells, with any combination of active or in- 13 active wells. 14 ‘‘(6) FEES FOR DRILLING RIGS.—Fees shall be 15 collected under this subsection for drilling rigs on a 16 per inspection basis. Fees for fiscal year 2020 shall 17 be— 18 ‘‘(A) $73,700 per inspection for rigs oper- 19 ating in water depths of 500 feet or more; and 20 ‘‘(B) $40,700 per inspection for rigs oper- 21 ating in water depths of less than 500 feet. 22 ‘‘(7) FEES FOR NON-RIG UNITS.—Fees shall be 23 collected under this subsection for well operations 24 conducted via non-rig units as outlined in subparts 25 5 •HR 1146 EH D, E, F, and Q of part 250 of title 30, Code of Fed- 1 eral Regulations, on a per inspection basis. Fees for 2 fiscal year 2020 shall be— 3 ‘‘(A) $29,172 per inspection for non-rig 4 units operating in water depths of 2,500 feet or 5 more; 6 ‘‘(B) $25,366 per inspection for non-rig 7 units operating in water depths between 500 8 and 2,499 feet; and 9 ‘‘(C) $9,834 per inspection for non-rig 10 units operating in water depths of less than 500 11 feet. 12 ‘‘(8) BILLING.—The Secretary shall bill des- 13 ignated operators under paragraph (5) annually, 14 with payment required within 30 days of billing. The 15 Secretary shall bill designated operators under para- 16 graph (6) within 30 days of the end of the month 17 in which the inspection occurred, with payment re- 18 quired within 30 days after billing.’’. 19 SEC. 4. DETERMINATION OF BUDGETARY EFFECTS. 20 The budgetary effects of this Act, for the purpose of 21 complying with the Statutory Pay-As-You-Go Act of 2010, 22 shall be determined by reference to the latest statement 23 titled ‘‘Budgetary Effects of PAYGO Legislation’’ for this 24 Act, submitted for printing in the Congressional Record 25 6 •HR 1146 EH by the Chairman of the House Budget Committee, pro- 1 vided that such statement has been submitted prior to the 2 vote on passage. 3 Passed the House of Representatives September 12, 2019.
