Be it enacted by the Senate and House of Representa- 1 tives of the United States of America in Congress assembled, 2 SECTION 1. DEFINITIONS. 1 In this Act: 2 (1) FEDERAL LAND AND WATERS.—The term 3 ‘‘Federal land and waters’’ means any Federal land 4 or body of water under the jurisdiction of any of the 5 Secretaries to which the public has access. 6 (2) PROGRAM.—The term ‘‘program’’ means 7 the Every Kid Outdoors program established under 8 section 3(a). 9 (3) SECRETARIES.—The term ‘‘Secretaries’’ 10 means— 11 (A) the Secretary of the Interior, acting 12 through— 13 (i) the Director of the National Park 14 Service; 15 (ii) the Director of the United States 16 Fish and Wildlife Service; 17 (iii) the Director of the Bureau of 18 Land Management; and 19 (iv) the Commissioner of Reclamation; 20 (B) the Secretary of Agriculture, acting 21 through the Chief of the Forest Service; 22 (C) the Secretary of Commerce, acting 23 through the Administrator of the National Oce- 24 anic and Atmospheric Administration; and 25 VerDate Sep 11 2014 00:07 Feb 26, 2019 Jkt 089200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\H1184.IH H1184 kjohnson on DSK79L0C42 with BILLS 3 •HR 1184 IH (D) the Secretary of the Army, acting 1 through the Chief of Engineers of the Corps of 2 Engineers. 3 (4) STATE.—The term ‘‘State’’ means each of 4 the several States, the District of Columbia, Amer- 5 ican Samoa, Guam, the Northern Mariana Islands, 6 Puerto Rico, the Virgin Islands of the United States, 7 and any other territory or possession of the United 8 States. 9 (5) STUDENT OR STUDENTS.—The term ‘‘stu- 10 dent’’ or ‘‘students’’ means any fourth grader or 11 home-schooled learner 10 years of age residing in 12 the United States, including any territory or posses- 13 sion of the United States. 14 SEC. 3. EVERY KID OUTDOORS PROGRAM. 15 (a) ESTABLISHMENT.—The Secretaries shall jointly 16 establish a program, to be known as the ‘‘Every Kid Out- 17 doors program’’, to provide free access to Federal land and 18 waters for students and accompanying individuals in ac- 19 cordance with this section. 20 (b) ANNUAL PASSES.— 21 (1) IN GENERAL.—At the request of a student, 22 the Secretaries shall issue a pass to the student, 23 which allows access to Federal lands and waters for 24 which access is subject to an entrance, standard 25 VerDate Sep 11 2014 00:07 Feb 26, 2019 Jkt 089200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6201 E:\BILLS\H1184.IH H1184 kjohnson on DSK79L0C42 with BILLS 4 •HR 1184 IH amenity, or day use fee, free of charge for the stu- 1 dent and— 2 (A) in the case of a per-vehicle fee area— 3 (i) any passengers accompanying the 4 student in a private, noncommercial vehi- 5 cle; or 6 (ii) not more than three adults accom- 7 panying the student on bicycles; or 8 (B) in the case of a per-person fee area, 9 not more than three adults accompanying the 10 student. 11 (2) TERM.—A pass described in paragraph (1) 12 shall be effective during the period beginning on 13 September 1 and ending on August 31 of the fol- 14 lowing year. 15 (3) PRESENCE OF A STUDENT IN GRADE FOUR 16 REQUIRED.—A pass described in paragraph (1) shall 17 be effective only if the student to which the pass was 18 issued is present at the point of entry to the applica- 19 ble Federal land or water. 20 (c) OTHER ACTIVITIES.—In carrying out the pro- 21 gram, the Secretaries— 22 (1) may collaborate with State Park systems 23 that opt to implement a complementary Every Kid 24 Outdoors State park pass; 25 VerDate Sep 11 2014 00:07 Feb 26, 2019 Jkt 089200 PO 00000 Frm 00004 Fmt 6652 Sfmt 6201 E:\BILLS\H1184.IH H1184 kjohnson on DSK79L0C42 with BILLS 5 •HR 1184 IH (2) may coordinate with the Secretary of Edu- 1 cation to implement the program; 2 (3) shall maintain a publicly available website 3 with information about the program; 4 (4) may provide visitor services for the pro- 5 gram; and 6 (5) may support approved partners of the Fed- 7 eral land and waters by providing the partners with 8 opportunities to participate in the program. 9 (d) REPORTS.—The Secretary of the Interior, in co- 10 ordination with each Secretary, shall prepare a com- 11 prehensive report to Congress each year describing— 12 (1) the implementation of the program; 13 (2) the number and geographical distribution of 14 students who participated in the program; and 15 (3) the number of passes described in sub- 16 section (b)(1) that were distributed. 17 Æ VerDate Sep 11 2014 00:07 Feb 26, 2019 Jkt 089200 PO 00000 Frm 00005 Fmt 6652 Sfmt 6301 E:\BILLS\H1184.IH H1184 kjohnson on DSK79L0C42 with BILLS
