Be it enacted by the Senate and House of Representa- 1 tives of the United States of America in Congress assembled, 2 SECTION 1. AMENDMENT TO INTERNAL REVENUE CODE OF 1 1986. 2 Subsection (g) of section 5845 of the Internal Rev- 3 enue Code of 1986 is amended to read as follows: 4 ‘‘(g) ANTIQUE FIREARM.— 5 ‘‘(1) IN GENERAL.—The term ‘antique firearm’ 6 means— 7 ‘‘(A) any firearm manufactured in or be- 8 fore the applicable year (including any 9 matchlock, flintlock, percussion cap, or similar 10 type of ignition system or replica thereof, 11 whether actually manufactured before or after 12 the applicable year), and 13 ‘‘(B) any firearm using fixed ammunition 14 manufactured in or before the applicable year, 15 for which ammunition is no longer manufac- 16 tured in the United States and is not readily 17 available in the ordinary channels of commercial 18 trade. 19 ‘‘(2) APPLICABLE YEAR.—For purposes of 20 paragraph (1), the term ‘applicable year’ means the 21 calendar year that is 100 years before the calendar 22 year in which the determination as to whether the 23 firearm meets the requirements of such paragraph is 24 being made.’’. 25 Æ VerDate Sep 11 2014 01:12 Feb 22, 2019 Jkt 089200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6301 E:\BILLS\S443.IS S443 pamtmann on DSKBFK8HB2PROD with BILLS
