Be it enacted by the Senate and House of Representa- 1 tives of the United States of America in Congress assembled, 2 SECTION 1. SHORT TITLE. 3 This Act may be cited as the ‘‘Frank and Jeanne 4 Moore Wild Steelhead Special Management Area Designa- 5 tion Act’’. 6 SEC. 2. FINDINGS. 7 Congress finds that— 8 (1) Frank Moore has committed his life to fam- 9 ily, friends, his country, and fly fishing; 10 VerDate Sep 11 2014 18:25 Feb 20, 2019 Jkt 089200 PO 00000 Frm 00001 Fmt 6652 Sfmt 6201 E:\BILLS\H1056.IH H1056 pamtmann on DSKBFK8HB2PROD with BILLS 2 •HR 1056 IH (2) Frank Moore is a World War II veteran 1 who stormed the beaches of Normandy along with 2 150,000 troops during the D-Day Allied invasion 3 and was awarded the Chevalier of the French Legion 4 of Honor for his bravery; 5 (3) Frank Moore returned home after the war, 6 started a family, and pursued his passion of fishing 7 on the winding rivers in Oregon; 8 (4) as the proprietor of the Steamboat Inn 9 along the North Umpqua River in Oregon for nearly 10 20 years, Frank Moore, along with his wife Jeanne, 11 shared his love of fishing, the flowing river, and the 12 great outdoors, with visitors from all over the United 13 States and the world; 14 (5) Frank Moore has spent most of his life fish- 15 ing the vast rivers of Oregon, during which time he 16 has contributed significantly to efforts to conserve 17 fish habitats and protect river health, including serv- 18 ing on the State of Oregon Fish and Wildlife Com- 19 mission; 20 (6) Frank Moore has been recognized for his 21 conservation work with the National Wildlife Fed- 22 eration Conservationist of the Year award, the Wild 23 Steelhead Coalition Conservation Award, and his 24 VerDate Sep 11 2014 18:25 Feb 20, 2019 Jkt 089200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\H1056.IH H1056 pamtmann on DSKBFK8HB2PROD with BILLS 3 •HR 1056 IH 2010 induction into the Fresh Water Fishing Hall 1 of Fame; and 2 (7) in honor of the many accomplishments of 3 Frank Moore, both on and off the river, approxi- 4 mately 99,653 acres of Forest Service land in the 5 State of Oregon should be designated as the ‘‘Frank 6 and Jeanne Moore Wild Steelhead Special Manage- 7 ment Area’’. 8 SEC. 3. DEFINITIONS. 9 In this Act: 10 (1) MAP.—The term ‘‘Map’’ means the map en- 11 titled ‘‘Frank Moore Wild Steelhead Special Man- 12 agement Area Designation Act’’ and dated June 23, 13 2016. 14 (2) SECRETARY.—The term ‘‘Secretary’’ means 15 the Secretary of Agriculture, acting through the 16 Chief of the Forest Service. 17 (3) SPECIAL MANAGEMENT AREA.—The term 18 ‘‘Special Management Area’’ means the Frank and 19 Jeanne Moore Wild Steelhead Special Management 20 Area designated by section 4(a). 21 (4) STATE.—The term ‘‘State’’ means the State 22 of Oregon. 23 VerDate Sep 11 2014 18:25 Feb 20, 2019 Jkt 089200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6201 E:\BILLS\H1056.IH H1056 pamtmann on DSKBFK8HB2PROD with BILLS 4 •HR 1056 IH SEC. 4. FRANK AND JEANNE MOORE WILD STEELHEAD SPE- 1 CIAL MANAGEMENT AREA, OREGON. 2 (a) DESIGNATION.—The approximately 99,653 acres 3 of Forest Service land in the State, as generally depicted 4 on the Map, is designated as the ‘‘Frank and Jeanne 5 Moore Wild Steelhead Special Management Area’’. 6 (b) MAP; LEGAL DESCRIPTION.— 7 (1) IN GENERAL.—As soon as practicable after 8 the date of enactment of this Act, the Secretary 9 shall prepare a map and legal description of the Spe- 10 cial Management Area. 11 (2) FORCE OF LAW.—The map and legal de- 12 scription prepared under paragraph (1) shall have 13 the same force and effect as if included in this Act, 14 except that the Secretary may correct clerical and 15 typographical errors in the map and legal descrip- 16 tion. 17 (3) AVAILABILITY.—The map and legal descrip- 18 tion prepared under paragraph (1) shall be on file 19 and available for public inspection in the appropriate 20 offices of the Forest Service. 21 (c) ADMINISTRATION.—Subject to valid existing 22 rights, the Special Management Area shall be adminis- 23 tered by the Secretary— 24 VerDate Sep 11 2014 18:25 Feb 20, 2019 Jkt 089200 PO 00000 Frm 00004 Fmt 6652 Sfmt 6201 E:\BILLS\H1056.IH H1056 pamtmann on DSKBFK8HB2PROD with BILLS 5 •HR 1056 IH (1) in accordance with all laws (including regu- 1 lations) applicable to the National Forest System; 2 and 3 (2) in a manner that— 4 (A) conserves and enhances the natural 5 character, scientific use, and the botanical, rec- 6 reational, ecological, fish and wildlife, scenic, 7 drinking water, and cultural values of the Spe- 8 cial Management Area; 9 (B) maintains and seeks to enhance the 10 wild salmonid habitat of the Special Manage- 11 ment Area; 12 (C) maintains or enhances the watershed 13 as a thermal refuge for wild salmonids; and 14 (D) preserves opportunities for recreation, 15 including primitive recreation. 16 (d) FISH AND WILDLIFE.—Nothing in this section 17 affects the jurisdiction or responsibilities of the State with 18 respect to fish and wildlife in the State. 19 (e) ADJACENT MANAGEMENT.—Nothing in this sec- 20 tion— 21 (1) creates any protective perimeter or buffer 22 zone around the Special Management Area; or 23 (2) modifies the applicable travel management 24 plan for the Special Management Area. 25 VerDate Sep 11 2014 18:25 Feb 20, 2019 Jkt 089200 PO 00000 Frm 00005 Fmt 6652 Sfmt 6201 E:\BILLS\H1056.IH H1056 pamtmann on DSKBFK8HB2PROD with BILLS 6 •HR 1056 IH (f) WILDFIRE MANAGEMENT.—Nothing in this sec- 1 tion prohibits the Secretary, in cooperation with other 2 Federal, State, and local agencies, as appropriate, from 3 conducting wildland fire operations in the Special Manage- 4 ment Area, consistent with the purposes of this Act, in- 5 cluding the use of aircraft, machinery, mechanized equip- 6 ment, fire breaks, backfires, and retardant. 7 (g) VEGETATION MANAGEMENT.—Nothing in this 8 section prohibits the Secretary from conducting vegetation 9 management projects within the Special Management 10 Area in a manner consistent with— 11 (1) the purposes described in subsection (c); 12 and 13 (2) the applicable forest plan. 14 (h) PROTECTION OF TRIBAL RIGHTS.—Nothing in 15 this section diminishes any treaty rights of an Indian 16 tribe. 17 (i) WITHDRAWAL.—Subject to valid existing rights, 18 the Federal land within the boundaries of the Special 19 Management Area river segments designated by sub- 20 section (a) is withdrawn from all forms of— 21 (1) entry, appropriation, or disposal under the 22 public land laws; 23 (2) location, entry, and patent under the mining 24 laws; and 25 VerDate Sep 11 2014 18:25 Feb 20, 2019 Jkt 089200 PO 00000 Frm 00006 Fmt 6652 Sfmt 6201 E:\BILLS\H1056.IH H1056 pamtmann on DSKBFK8HB2PROD with BILLS 7 •HR 1056 IH (3) disposition under all laws relating to min- 1 eral and geothermal leasing or mineral materials. 2 Æ VerDate Sep 11 2014 18:25 Feb 20, 2019 Jkt 089200 PO 00000 Frm 00007 Fmt 6652 Sfmt 6301 E:\BILLS\H1056.IH H1056 pamtmann on DSKBFK8HB2PROD with BILLS
