Mr. WELCH (for himself and Mr. NORMAN) introduced the following bill;
which was referred to the Committee on Energy and Commerce, and in
addition to the Committee on Oversight and Reform, for a period to be
subsequently determined by the Speaker, in each case for consideration
of such provisions as fall within the jurisdiction of the committee con-
cerned

To authorize certain long-term contracts for Federal
purchases of energy.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

This Act may be cited as the ‘‘Renewable Energy
4
Certainty Act’’.

SEC. 2. CONTRACTS FOR FEDERAL PURCHASES OF EN-

(a) IN GENERAL.—Part 3 of title V of the National
3
Energy Conservation Policy Act (42 U.S.C. 8251 et seq.)

is amended by adding at the end the following new section:
5
‘‘SEC. 554. LONG-TERM CONTRACTS FOR ENERGY.

‘‘(a)
IN
GENERAL.—Notwithstanding
section
7
501(b)(1)(B) of title 40, United States Code, an agency
8
may enter into a contract for the acquisition of energy
9
generated from renewable energy sources or from cogen-
10
eration facilities covering a period of not more than 30
11
years.

‘‘(b) STANDARDIZED ENERGY PURCHASE AGREE-
13
MENT.—Not later than 90 days after the date of enact-
14
ment of this section, the Secretary, through the Federal
15
Energy Management Program, shall publish a standard-
16
ized energy purchase agreement, setting forth commercial
17
terms and conditions, that agencies may use to acquire
18
energy generated from renewable energy sources or from
19
cogeneration facilities.

‘‘(c) TECHNICAL ASSISTANCE.—The Secretary shall
21
provide technical assistance to assist agencies in imple-
22
menting this section.’’.
