Be it enacted by the Senate and House of Representa- 1 tives of the United States of America in Congress assembled, 2 SECTION 1. SHORT TITLE. 3 This Act may be cited as the ‘‘Federal Civilian Work- 4 force Pay Raise Fairness Act of 2019’’. 5 SEC. 2. PAY INCREASE FOR CERTAIN FEDERAL GOVERN- 6 MENT EMPLOYEES IN 2019. 7 (a) DEFINITIONS.—In this section— 8 VerDate Sep 11 2014 16:15 Feb 02, 2019 Jkt 089200 PO 00000 Frm 00001 Fmt 6652 Sfmt 6201 E:\BILLS\S262.IS S262 pbinns on DSK79D2C42PROD with BILLS 2 •S 262 IS (1) the term ‘‘career appointee’’ has the mean- 1 ing given the term in section 3132(a) of title 5, 2 United States Code; 3 (2) the term ‘‘excepted service’’ has the mean- 4 ing given the term in section 2103 of title 5, United 5 States Code; 6 (3) the term ‘‘FBI–DEA Senior Executive 7 Service’’ means the personnel system described in 8 section 3151(a) of title 5, United States Code; and 9 (4) the term ‘‘statutory pay system’’ has the 10 meaning given the term in section 5302 of title 5, 11 United States Code. 12 (b) STATUTORY PAY SYSTEMS.—For calendar year 13 2019, the percentage adjustment under section 5303 of 14 title 5, United States Code, in the rates of basic pay under 15 the statutory pay systems shall be 2.6 percent. 16 (c) PREVAILING RATE EMPLOYEES.—Notwith- 17 standing the wage survey requirements under section 18 5343(b) of title 5, United States Code, for fiscal year 19 2019, the rates of basic pay (as in effect on September 20 30, 2018, under section 5343(a) of that title) for pre- 21 vailing rate employees in each wage area and the rates 22 of basic pay under sections 5348 and 5349 of that title 23 shall be increased by 2.6 percent. 24 VerDate Sep 11 2014 16:15 Feb 02, 2019 Jkt 089200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\S262.IS S262 pbinns on DSK79D2C42PROD with BILLS 3 •S 262 IS (d) SENIOR EXECUTIVE SERVICE CAREER AP- 1 POINTEES.—For calendar year 2019, the rate of basic pay 2 for any career appointee and for any career position in 3 the FBI–DEA Senior Executive Service shall be the rate 4 of pay in effect for the position on December 31, 2018, 5 increased by 2.6 percent. 6 (e) SENIOR-LEVEL AND SCIENTIFIC AND PROFES- 7 SIONAL POSITIONS.—For calendar year 2019, the rate of 8 basic pay for any position to which section 5376 of title 9 5, United States Code, applies shall be the rate of pay 10 in effect for the position on December 31, 2018, increased 11 by 2.6 percent. 12 (f) EXCEPTED SERVICE.—For calendar year 2019, 13 the rate of basic pay for any position in the excepted serv- 14 ice shall be the rate of pay in effect for the position on 15 December 31, 2018, increased by 2.6 percent. 16 (g) APPLICATION.— 17 (1) IN GENERAL.—The adjustments in pay 18 made under this Act shall apply beginning on the 19 date of enactment of this Act. 20 (2) OTHER ADJUSTMENTS PERMITTED; LIM- 21 ITS.—Nothing in this Act may be construed to— 22 (A) limit any other increase, including an 23 allowance, a performance award, or a bonus, 24 VerDate Sep 11 2014 16:15 Feb 02, 2019 Jkt 089200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6201 E:\BILLS\S262.IS S262 pbinns on DSK79D2C42PROD with BILLS 4 •S 262 IS otherwise permitted under law to any rate of 1 pay adjusted under this Act; or 2 (B) waive any provision of law, rule, or 3 regulation, including section 5307 of title 5, 4 United States Code, limiting total aggregate 5 pay. 6 Æ VerDate Sep 11 2014 16:15 Feb 02, 2019 Jkt 089200 PO 00000 Frm 00004 Fmt 6652 Sfmt 6301 E:\BILLS\S262.IS S262 pbinns on DSK79D2C42PROD with BILLS
