SHORT TITLE. 1 This Act may be cited as the ‘‘Education and Energy 2 Act of 2019’’. 3 SEC. 2. USE OF REVENUES FROM NEW FEDERAL MINERAL 4 AND GEOTHERMAL LEASES FOR PAYMENTS 5 TO STATE FOR EDUCATION. 6 Section 35(a) of the Mineral Leasing Act (30 U.S.C. 7 191) is amended by inserting ‘‘(1)’’ before the first sen- 8 tence, and by adding at the end the following new para- 9 graph: 10 ‘‘(2)(A) Of amounts otherwise required under 11 paragraph (1) to be deposited into the general fund 12 of the Treasury each fiscal year that are derived 13 from leases for tracts located in a State, the Sec- 14 retary shall pay to the county from which the min- 15 eral or geothermal royalties were generated 33 per- 16 cent for use to supplement the education of students 17 in kindergarten through grade 12 and to supplement 18 public support of institutions of higher education. 19 ‘‘(B) Of the amounts otherwise required under 20 paragraph (1) to be deposited into the general fund 21 of the Treasury each fiscal year that are not re- 22 quired to be used for payments under subparagraph 23 (A) of this paragraph, the Secretary shall pay to 24 States, in equal amounts, 17 percent for use to sup- 25 plement the education of students in kindergarten 26 VerDate Sep 11 2014 00:41 Feb 02, 2019 Jkt 089200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\H786.IH H786 kjohnson on DSK79L0C42 with BILLS 3 •HR 786 IH through grade 12 and to supplement public support 1 of institutions of higher education. 2 ‘‘(C) Subparagraphs (A) and (B) shall apply 3 only with respect to amounts that— 4 ‘‘(i) are received by the United States 5 under leases entered into under this Act or the 6 Geothermal Steam Act of 1970 after the date 7 of enactment of the Education and Energy Act 8 of 2019; and 9 ‘‘(ii) exceed the amount of revenues that 10 the Congressional Budget Office previously esti- 11 mated would be received under such leases in 12 the fiscal year. 13 ‘‘(D) Subparagraphs (A) and (B) shall not 14 apply with respect to amounts required by para- 15 graph (1) to be paid into, reserved, or appropriated 16 as part of the reclamation fund. 17 ‘‘(E) Any amounts received by a county under 18 subparagraph (A) shall not be considered when cal- 19 culating payments to that county under the Secure 20 Rural Schools and Community Self-Determination 21 Act of 2000 (16 U.S.C. 7101 et seq.) or chapter 69 22 of title 31, United States Code.’’. 23 Æ VerDate Sep 11 2014 00:41 Feb 02, 2019 Jkt 089200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6301 E:\BILLS\H786.IH H786 kjohnson on DSK79L0C42 with BILLS
