ONSHORE DOMESTIC ENERGY PRODUCTION STRA- 1 TEGIC PLAN. 2 (a) IN GENERAL.—The Mineral Leasing Act (30 3 U.S.C. 181 et seq.) is amended by redesignating section 4 44 as section 45, and by inserting after section 43 the 5 following: 6 ‘‘SEC. 44. QUADRENNIAL FEDERAL ONSHORE ENERGY PRO- 7 DUCTION STRATEGY. 8 ‘‘(a) REQUIREMENT TO PUBLISH QUADRENNIAL 9 FEDERAL ONSHORE ENERGY PRODUCTION STRATEGY.— 10 The Secretary shall develop and publish once every 4 years 11 a Quadrennial Federal Onshore Energy Production Strat- 12 egy. 13 ‘‘(b) CONSULTATIONS REQUIRED.—In developing the 14 Strategy, the Secretary shall consult with— 15 ‘‘(1) the Administrator of the Energy Informa- 16 tion Administration with regard to— 17 ‘‘(A) the projected energy demands of the 18 United States for the next 30-year period; 19 ‘‘(B) the methodology used to arrive at 20 such projection; and 21 ‘‘(C) actions to be taken during the next 4- 22 year period with the goal of meeting such de- 23 mands; 24 ‘‘(2) the Secretary of Agriculture with regard to 25 lands administered by such Secretary; and 26 VerDate Sep 11 2014 00:41 Feb 02, 2019 Jkt 089200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\H785.IH H785 kjohnson on DSK79L0C42 with BILLS 3 •HR 785 IH ‘‘(3) the Secretary of Energy with regard to en- 1 ergy transmission, storage, and distribution infra- 2 structure. 3 ‘‘(c) STATE, FEDERALLY RECOGNIZED INDIAN 4 TRIBES, LOCAL GOVERNMENT, AND PUBLIC INPUT.—In 5 developing the Strategy, the Secretary shall solicit the 6 input of— 7 ‘‘(1) the State, federally recognized Indian 8 Tribe, or local government where each energy project 9 included in the Strategy is proposed to be located; 10 and 11 ‘‘(2) the public. 12 ‘‘(d) CONTENTS OF STRATEGY.— 13 ‘‘(1) IN GENERAL.—The Strategy shall direct 14 onshore Federal land energy development and de- 15 partment resource allocation in order to promote the 16 energy security and national security of the United 17 States in accordance with the principles of multiple 18 use and sustained yield. 19 ‘‘(2) PROJECTED DOMESTIC DEMAND FOR EN- 20 ERGY RESOURCES.—The Secretary, in consultation 21 with the Administrator of the Energy Information 22 Administration, shall include in the Strategy an esti- 23 mate, based upon commercial and scientific data, of 24 the projected domestic demand for energy resources 25 VerDate Sep 11 2014 00:41 Feb 02, 2019 Jkt 089200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6201 E:\BILLS\H785.IH H785 kjohnson on DSK79L0C42 with BILLS 4 •HR 785 IH over the 30-year period beginning on the date of the 1 publication of such Strategy. The estimate shall be 2 disaggregated by the energy resource types listed in 3 subparagraphs (A) through (H) of paragraph (3) 4 and expressed in British thermal units or 5 megawatts, as appropriate. 6 ‘‘(3) DOMESTIC STRATEGIC PRODUCTION OB- 7 JECTIVE.—The Secretary shall include in the Strat- 8 egy a domestic strategic production objective based 9 on the estimate in paragraph (2) for the develop- 10 ment of the following energy resource types on Fed- 11 eral onshore lands: 12 ‘‘(A) Oil and natural gas. 13 ‘‘(B) Coal. 14 ‘‘(C) Strategic and critical energy min- 15 erals. 16 ‘‘(D) Electricity, in megawatts, from each 17 of wind, solar, biomass, hydropower, and geo- 18 thermal energy. 19 ‘‘(E) Energy from unconventional energy 20 production, such as oil shale. 21 ‘‘(F) Helium. 22 ‘‘(G) Oil, natural gas, coal, and other re- 23 newable sources from the Tribal lands of any 24 federally recognized Indian Tribe that elects to 25 VerDate Sep 11 2014 00:41 Feb 02, 2019 Jkt 089200 PO 00000 Frm 00004 Fmt 6652 Sfmt 6201 E:\BILLS\H785.IH H785 kjohnson on DSK79L0C42 with BILLS 5 •HR 785 IH participate in facilitating energy production on 1 its lands. 2 ‘‘(H) Other energy production technology 3 sources or advancements in energy, as deter- 4 mined by the Secretary. 5 ‘‘(4) CONSIDERATIONS.—In the Strategy, the 6 Secretary shall consider— 7 ‘‘(A) how Federal lands will contribute to 8 ensuring national energy security, with a goal 9 for increasing energy independence and produc- 10 tion during the next 4-year period; 11 ‘‘(B) the ability of existing energy trans- 12 mission, storage, and distribution infrastructure 13 to efficiently utilize energy production from 14 Federal lands; and 15 ‘‘(C) the proportion of total energy produc- 16 tion derived from Federal land compared to 17 non-Federal land for each of the energy re- 18 sources listed in subparagraphs (A) through 19 (H) of paragraph (3). 20 ‘‘(e) TRIBAL OBJECTIVES.—It is the sense of Con- 21 gress that federally recognized Indian Tribes may elect to 22 set their own production objectives as part of the Strategy. 23 The Secretary shall work in cooperation with any federally 24 VerDate Sep 11 2014 00:41 Feb 02, 2019 Jkt 089200 PO 00000 Frm 00005 Fmt 6652 Sfmt 6201 E:\BILLS\H785.IH H785 kjohnson on DSK79L0C42 with BILLS 6 •HR 785 IH recognized Indian Tribe that elects to participate in 1 achieving its own strategic energy objectives. 2 ‘‘(f) REPORT REQUIRED.—The Secretary shall sub- 3 mit a report annually to the Committee on Natural Re- 4 sources of the House of Representatives and the Com- 5 mittee on Energy and Natural Resources of the Senate 6 that— 7 ‘‘(1) examines the progress made toward meet- 8 ing the domestic strategic production objective set 9 forth in the Strategy; 10 ‘‘(2) identifies projections for production and 11 capacity installations and any problems with leasing, 12 permitting, siting, or production that may prevent 13 meeting the domestic strategic production objective 14 set forth in the Strategy; and 15 ‘‘(3) provides suggestions to address any short- 16 falls in meeting the domestic strategic production 17 objective set forth in the Strategy. 18 ‘‘(g) CONGRESSIONAL REVIEW.—At least 60 days be- 19 fore publishing a proposed Strategy under this section, the 20 Secretary shall submit such Strategy to the President and 21 to Congress, together with any comments received from 22 States, federally recognized Indian Tribes, and local gov- 23 ernments. Such submission shall state why any specific 24 VerDate Sep 11 2014 00:41 Feb 02, 2019 Jkt 089200 PO 00000 Frm 00006 Fmt 6652 Sfmt 6201 E:\BILLS\H785.IH H785 kjohnson on DSK79L0C42 with BILLS 7 •HR 785 IH recommendation of a State, federally recognized Indian 1 Tribe, or local government was not accepted. 2 ‘‘(h) DEFINITIONS.—In this section: 3 ‘‘(1) MULTIPLE USE.—The term ‘multiple use’ 4 has the same meaning given such term in section 5 103 of the Federal Land and Policy Management 6 Act of 1976 (43 U.S.C. 1702). 7 ‘‘(2) SECRETARY.—The term ‘Secretary’ means 8 the Secretary of the Interior, unless the context re- 9 quires otherwise. 10 ‘‘(3) STRATEGY.—The term ‘Strategy’ means 11 the Quadrennial Federal Onshore Energy Produc- 12 tion Strategy required to be developed and published 13 under subsection (a). 14 ‘‘(4) STRATEGIC AND CRITICAL ENERGY MIN- 15 ERALS.—The term ‘strategic and critical energy 16 minerals’ means minerals that are necessary for the 17 production of energy and the building and maintain- 18 ing of the energy infrastructure of the United 19 States, including minerals necessary— 20 ‘‘(A) for pipelines, refining capacity, elec- 21 trical power generation and transmission, and 22 renewable energy production; 23 VerDate Sep 11 2014 00:41 Feb 02, 2019 Jkt 089200 PO 00000 Frm 00007 Fmt 6652 Sfmt 6201 E:\BILLS\H785.IH H785 kjohnson on DSK79L0C42 with BILLS 8 •HR 785 IH ‘‘(B) to support domestic manufacturing, 1 including materials used in energy generation, 2 production, and transportation; and 3 ‘‘(C) to ensure the national security of the 4 United States. 5 ‘‘(5) SUSTAINED YIELD.—The term ‘sustained 6 yield’ has the same meaning given such term in sec- 7 tion 103 of the Federal Land and Policy Manage- 8 ment Act of 1976 (43 U.S.C. 1702).’’. 9 (b) FIRST QUADRENNIAL STRATEGY.—Not later 10 than 18 months after the date of the enactment of this 11 Act, the Secretary of the Interior shall submit to Congress 12 the first Quadrennial Federal Onshore Energy Production 13 Strategy under the amendment made by subsection (a). 14 Æ VerDate Sep 11 2014 00:41 Feb 02, 2019 Jkt 089200 PO 00000 Frm 00008 Fmt 6652 Sfmt 6301 E:\BILLS\H785.IH H785 kjohnson on DSK79L0C42 with BILLS
