To amend title 49, United States Code, to limit eligibility
for essential air service for certain locations, and for
other purposes.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

This Act may be cited as the ‘‘Defending Essential
4
Flights and Ensuring National Security Efforts Act of
5
2019’’ or the ‘‘DEFENSE Act of 2019’’.

SEC. 2. EXCEPTION FOR CERTAIN LOCATIONS WITH HIGH
7
MILITARY USE.

Section 41731 of title 49, United States Code, is
9
amended by adding at the end the following:

‘‘(g) EXCEPTION FOR CERTAIN LOCATIONS WITH

HIGH MILITARY USE.—Subparagraph (D) of subsection
2
(a)(1) shall not apply with respect to any location—
3
‘‘(1) that is certified under part 139 of title 14,
4
Code of Federal Regulations;
5
‘‘(2) that is not owned by the Federal Govern-
6
ment; and
7
‘‘(3) at which not less than 10 percent of air-
8
craft takeoffs and landings in 2018 were by aircraft
9
of the Armed Forces.’’.
