A BILL
To provide, in the event of a Government shutdown during
fiscal year 2019, continuing appropriations to members
and employees of the Coast Guard and law enforcement
officers and custom and border protection officers within
the Department of Homeland Security, and for other
purposes.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

This Act may be cited as the ‘‘Pay our Homeland
4
Heroes Act’’.

SEC. 2. CONTINUING APPROPRIATIONS FOR COAST GUARD

AND LAW ENFORCEMENT OFFICERS AND
2
CUSTOM AND BORDER PROTECTION OFFI-
3
CERS IN THE DEPARTMENT OF HOMELAND
4
SECURITY.

(a) IN GENERAL.—There are hereby appropriated for
6
fiscal year 2019, out of any money in the Treasury not
7
otherwise appropriated, for any period during which in-
8
terim or full-year appropriations for fiscal year 2019 are
9
not in effect—
10
(1) such sums as are necessary to provide pay
11
and allowances to members and employees of the
12
Coast Guard; and
13
(2) such sums as are necessary to provide the
14
salary and expenses of any law enforcement officer
15
(as that term is defined in section 8401(17) of title
16
5, United States Code) or customs and border pro-
17
tection officer (as that term is defined in section
18
8401(36) of such title) within the Department of
19
Homeland Security.

(b) AVAILABILITY.—Appropriations and funds made
21
available and authority granted pursuant to subsection (a)
22
shall be available until whichever of the following first oc-
23
curs:
24
(1) The enactment into law of an appropriation
25
(including a continuing appropriation) for any pur-

pose for which amounts are made available in sub-

section (a).

(2) The enactment into law of the applicable
3
regular or continuing appropriations resolution or
4
other Act without any appropriation for such pur-
5
pose.

(c) BACKPAY.—With respect to the period of a lapse
7
in the appropriations described in subsection (a) beginning
8
on or around December 22, 2018, and ending on the date
9
of enactment of this Act, compensation provided by this
10
section shall be considered to be payments made in accord-
11
ance with subsection (c) of section 1341 of title 31, United
12
States Code, as added by the Government Employee Fair
13
Treatment Act of 2019.
