SECTION 1. SHORT TITLE.

This Act may be cited as the ‘‘Federal Civilian Work-
2
force Pay Raise Fairness Act of 2019’’.

SEC. 2. PAY INCREASE FOR CERTAIN FEDERAL GOVERN-
4
MENT EMPLOYEES IN 2019.

(a) STATUTORY PAY SYSTEMS.—For calendar year
6
2019, the percentage adjustment under section 5303 of
7
title 5, United States Code, in the rates of basic pay under
8
the statutory pay systems (as defined in section 5302 of
9
such title) shall be 2.6 percent.

(b)
PREVAILING
RATE
EMPLOYEES.—Notwith-
11
standing the wage survey requirements under section
12
5343(b) of title 5, United States Code, for fiscal year
13
2019, the rates of basic pay (as in effect on the last day
14
of fiscal year 2018 under section 5343(a) of such title)
15
for prevailing rate employees in each wage area and the
16
rates of basic pay under sections 5348 and 5349 of such
17
title shall be increased by 2.6 percent.

(c) SENIOR
EXECUTIVE
SERVICE
CAREER
AP-
19
POINTEES.—For calendar year 2019, the rate of basic pay
20
for any career position within the Senior Executive Service
21
or the FBI–DEA Senior Executive Service (as that term
22
is defined in section 3151(a) of title 5, United States
23
Code) shall be the rate of pay for any such position on
24
December 31, 2018, increased by 2.6 percent.

(d) SENIOR-LEVEL AND SCIENTIFIC AND PROFES-

SIONAL POSITIONS.—For calendar year 2019, the rates
2
of basic pay for any senior-level and scientific and profes-
3
sional position under section 5376 of title 5, United States
4
Code, shall be the rate of pay for any such position on
5
December 31, 2018, increased by 2.6 percent.
6
(e) EXCEPTED SERVICE.—For calendar year 2019,
7
the rate of basic pay for any position in the excepted serv-
8
ice (as that term is defined by section 2103 of title 5,
9
United States Code) shall be the rate of pay for any such
10
position on December 31, 2018, increased by 2.6 percent.
11
(f) SECRET SERVICE EMPLOYEES.—For calendar
12
year 2019, the rate of basic pay of any employee of the
13
United States Secret Service provided under chapter 102
14
of title 5, United States Code, who did not receive a pay
15
increase by operation of subsections (a) through (e) shall
16
be increased by 2.6 percent.

(g) NASA EMPLOYEES.—For calendar year 2019,
18
the rate of basic pay of any employee of the National Aero-
19
nautics and Space Administration provided under chapter
20
98 of title 5, United States Code, who did not receive a
21
pay increase by operation of subsections (a) through (e)
22
shall be increased by 2.6 percent.
23
(h) IRS EMPLOYEES.—For calendar year 2019, the
24
rate of basic pay of any employee of the Internal Revenue

Service provided under chapter 95 of title 5, United States

Code, who did not receive a pay increase by operation of
2
subsections (a) through (e) shall be increased by 2.6 per-
3
cent.

(i) APPLICATION.—
5
(1) IN
GENERAL.—The adjustments in pay
6
made under this Act shall apply beginning on the
7
date of enactment of this Act.
8
(2) OTHER
ADJUSTMENTS
PERMITTED; LIM-
9
ITS.—Nothing in this Act shall be construed to—
10
(A) limit any other increase, including al-
11
lowances, performance awards, or bonuses, oth-
12
erwise permitted under law to any a rate of pay
13
adjusted under this Act; or
14
(B) waive any provision of law, rule, or
15
regulation, including section 5307 of title 5,
16
United States Code, limiting total aggregate
17
pay.
