A BILL
To provide the payment of salaries to Federal employees
and employees of the District of Columbia excepted from
furlough during a lapse in appropriations during fiscal
year 2019, and for other purposes.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.
3
This Act may be cited as the ‘‘Fairness to Essential
4
Workers Act’’.

SEC. 2. PROVIDING PAY TO EXCEPTED EMPLOYEES DUR-

ING LAPSES IN APPROPRIATIONS DURING
2
FISCAL YEAR 2019.

(a) IN GENERAL.—
4
(1) DECEMBER 2018 SHUTDOWN.—With respect
5
to the lapse in appropriations beginning on or after
6
December 22, 2018—
7
(A) each excepted employee (as that term
8
is defined in section 1341(c)(1)(D) of title 31,
9
United States Code) who was required to per-
10
form work during the period beginning on the
11
first day of such lapse and ending on the date
12
of enactment of this section shall be paid for
13
such work, at the employee’s standard rate of
14
pay, at the earliest date possible after the date
15
of enactment, regardless of scheduled pay dates;
16
and
17
(B) for the remainder of such lapse, each
18
excepted employee who is required to perform
19
work during such remainder shall be paid for
20
such work, at the employee’s standard rate of
21
pay, on the employee’s scheduled pay dates.

(2) SUBSEQUENT
LAPSES
IN
FISCAL
YEAR
23
2019.—During any lapse in appropriations during
24
fiscal year 2019 beginning after the lapse in appro-
25
priations described in paragraph (1) ends, each ex-

cepted employee who is required to perform work

during a covered lapse in appropriations shall be
2
paid for such work, at the employee’s standard rate
3
of pay, on the employee’s scheduled pay dates.

(b) APPROPRIATION.—There are appropriated such
5
sums as are necessary to carry out this section.
