A BILL
To amend title 31, United States Code, to provide pay to
employees excepted from furlough during a Government
shutdown, and for other purposes.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.
3
This Act may be cited as the ‘‘Never Again Act’’.
4
SEC. 2. PROVIDING SALARIES TO EXCEPTED EMPLOYEES
5
DURING A GOVERNMENT SHUTDOWN.

Section 1341 of title 31, United States Code, is
7
amended in subsection (c), as added by the Government
8
Employee Fair Treatment Act of 2019, by striking para-
9
graph (2) and inserting the following:

‘‘(2)(A) Each employee of the United States Govern-
1
ment or of a District of Columbia public employer fur-
2
loughed as a result of a covered lapse in appropriations
3
shall be paid for the period of the lapse in appropriations,
4
at the employee’s standard rate of pay, at the earliest date
5
possible after such lapse in appropriations ends, regardless
6
of scheduled pay dates.

‘‘(B)(i) With respect to the lapse in appropriations
8
beginning on or around December 22, 2018—
9
‘‘(I) each excepted employee who was required
10
to perform work during the period beginning on the
11
first day of such lapse and ending on the date of en-
12
actment of the Never Again Act shall be paid for
13
such work, at the employee’s standard rate of pay,
14
at the earliest date possible after the date of enact-
15
ment, regardless of scheduled pay dates; and
16
‘‘(II) for the remainder of such lapse, each ex-
17
cepted employee who is required to perform work
18
during such remainder shall be paid for such work,
19
at the employee’s standard rate of pay, on the em-
20
ployee’s scheduled pay dates.

‘‘(ii) During any covered lapse in appropriations be-
22
ginning after the lapse in appropriations described in
23
clause (i) ends, each excepted employee who is required
24
to perform work during a covered lapse in appropriations

shall be paid for such work, at the employee’s standard

‘‘(iii) There are appropriated such sums as are nec-

essary to carry out this subparagraph.’’.
