To prohibit the sale of shark parts, and for other purposes.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

This Act may be cited as the ‘‘Shark Sales Elimi-
4
nation Act of 2019’’.

SEC. 2. PROHIBITION ON SALE OF SHARK PARTS.

(a) PROHIBITION.—Except as provided in section 3,
7
no person shall possess, offer for sale, sell, or purchase
8
any shark part or product containing any shark part.
9
(b) PENALTY.—For purposes of section 308(a) of the
10
Magnuson-Stevens Fishery Conservation and Manage-
11
ment Act (16 U.S.C. 1858(a)), a violation of this section

shall be treated as an act prohibited by section 307 of

that Act (16 U.S.C. 1857).

SEC. 3. EXEMPTION FOR TRADITIONAL FISHERIES, EDU-
3
CATION, AND SCIENCE.

Section 2 shall not apply with respect to possession
5
of a shark part that was taken lawfully under a State,
6
territorial, or Federal license or permit to take or land
7
sharks, if the shark part is separated from the shark in
8
a manner consistent with the license or permit and is—
9
(1) destroyed or discarded;
10
(2) used for noncommercial subsistence pur-
11
poses in accordance with State or territorial law; or
12
(3) used solely for display or research purposes
13
by a museum, college, or university, or other person
14
under a State or Federal permit to conduct non-
15
commercial scientific research.

SEC. 4. DEFINITIONS.

In this Act:

(1) SHARK.—The term ‘‘shark’’ means any spe-
19
cies of the orders Pristiophoriformes, Squatini-
20
formes,
Squaliformes,
Hexanchiformes,
Lamni-
21
formes, Carchariniformes, Orectolobiformes, and
22
Heterodontiformes.

(2) SHARK
PART.—The term ‘‘shark part’’
1
means any shark or raw, dried, or otherwise proc-
2
essed detached part of a shark.

SEC. 5. STATE AUTHORITY.
4
Nothing in this Act affects any right of a State or
5
territory of the United States to adopt or enforce any reg-
6
ulation or standard that is more stringent than a regula-
7
tion or standard in effect under this Act.
